    MESSAGE FROM GEN SECRETARY




    Dear Veterans, 
    As all of you know that we PBORs are being discriminated and cheated by our political leaders and bureaucrats’ right from 1973 and again in Jan 2006 when the report of 6 CPC was published. So many methods adopted which resulted the pension of PBORs of all the three forces was short fixed. Below mentioned main problems in our pension are:-
    1. Pension of PBORs of all the three forces linked with 33 year qualifying service, while no such orders exist that pers from sep to Sub Maj. and equivalent in other forces can serve for 33 years.
    2. Retirees who got Hon ranks after retirement are not getting pension of that rank but being given small amount with pension of previous rank. It should have been changed as in the case of officers.
    3. Different methods are adopted for calculating the pensions which caused PBORs Of three forces are under heavy financial loss since 1973 and 2006.
    4. Military service pay should be given equal to all ranks of Army, Navy and Air force.
    5. Pension of widows is very less, these great women running door to door for fulfill their daily requirement, No arrangements are made for their children's life.
    6. Same problems being faced by the disabled soldiers of all the three forces. So dear veteran above mentioned problems are only pension related, there are some other problems also like job, self employment, ECHS and CSD canteen facilities etc.
    To solve above mentioned problems we have decided that we must stand on our own feet. We should not expect others to help us as they have done nothing for our welfare.
    Keeping above problems in mind we have registered a association for JCOS, ORS and Hon commissioned Offers (equivalent in Navy and Air Force) Named ARMED FORCES VETERAN ASSOCIATION OF INDIA (AFVAI) on all INDIA LEVEL.
    It is my humble request to all concerned vets and respected widows to to join your own org (AFVAI) and assist to solve our problems.

    1. If GOI decides to implement OROP for PBORs on the basis of their group X and Y, will it be considered as dilution from the OROP already approved by the parliament or not?

    2. If it is a dilution, then what would be the stand of UFFXSM?

    3. Will the UFFXSM stand by PBORs to reject such a proposal outright and continue with the agitation until the dilution is rectified?
    4. If it is not a dilution, then what exactly UFFXSM mean by 'dilution'?

    RELAY HUNGER STRIKE AT JANTAR MANTAR NEW DELHI REQUIREMENT OF VOLUNTEERS
    Dear Friends,


    1. We are in our 52nd day of Relay Hunger Strike at Jantar Mantar and at more than 50 locations across the country for Non-Implementation of One Rank One Pension (OROP) inspite of its sanction by the Govt more than 17 months ago.


    2. While the “Jathas” of ESM are coming from various states for the Relay Hunger Strike, we need a sizeable member of ESM and our supporters to be present at the relay Hunger Strike locations to encourage them and also to showcase solidarity to the cause of “Justice to the Soldiers”. May we request for volunteers to assist the management of relay Hunger Strike at Jantar Mantar.


    3. May we also request all ESM residing in and around NCR to visit Jantar Mantar every day to ensure a sizeable presence?


    4. Let us all join to strengthen the Protest Movement across the country.

    Pre-2006 pensioners having less than 33 years of service not affected by DOPPW circular dated 30/07/2017

     Sequence of events in pre-2006 pensioners case
    The First case OA 655/2010 was field in CAT PB by S-29( Railway officers who are having more than 33 years of service) association pleading for Modified parity to pre-2006 pensioners.
    Another three set of petitions were filed by others pleading for full parity with post 2006 pensioners including 50% pension to less than 33 years of service in CAT PB & cases numbered OA/3079/2009,OA 0306/2010,OA 0507/2010.
    The CAT PB clubbed all the three cases together & heard the argument. The judgement was also given together in all these four cases.
    The Govt filed appeal in DHC against the verdict of CAT PB & again all these four cases Numbered WP(C) 1535/2012(Modified parity only), 2348-2350/2012(Full parity & 50%) were clubbed & heard by DHC.The judgements were given together but under respective cases.
     Here Govt filed a curative petition in SC together & could not succeed.
    Here after the Govt splitted the cases & filed an SLP in SC numbered SLP (C) 23055/2013  only against WP(C) 1535 (OA 655/2010 for modified parity only)  & the SC dismissed the SLP. Consequently the Govt paid the amount to Members of the petitioners only.
     After this The Govt filed SLP in SC against the verdict of DHC in rest of the 3 cases 2348-2350/2012 & the cases numbered by SC as SLP(C) 36148-36150/2013(Full parity & 50%) were heard together & dismissed on 17/03/2015 & ordered to pay the arrears w.e.f.01/01/2006 with in 4 months .The deadline for compliance of this judgement has expired on 17/07/2015.The petitioners of SLP 36148-50 have to approach the SC for contempt of court for non-implementation of court order.The recent Circular dated 30/07/2015 issued by DOPPW is only extending the applicability of judgement in OA 655/2010 to applicants other than petitioners in the above case.Hence this Circular have no effect on the pre2006 pensioners who are having less than 33 years of service.

    IN THE HIGH COURT OF DELHI AT NEW DELHI

    Date of Decision: April 29, 2013
        PARA-26.of judgement
    It  is for the aforesaid reasons,we remark that there is no need to go into the legal nuances. Simple solution is to give effect to the resolution dated29.08.2008 whereby recommendations of the 6 th Central Pay Commission were accepted with certain modifications. We find force in the submission of learned counsel for the petitioners that subsequent OMs dated 03.10.2008 and 14.10.2008 were not in consonance with that resolution. Once we find that this resolution ensures that “the fixation of pension will be subject to the provision that the revised pension, in no case, shall be lower than 50% of the sum of the minimum of the pay in the pay band and the grade pay thereon corresponding to the pee-revised pay scale from which the pensioner had retired”, this would clearly mean that the pay of the retiree i.e. who retired before 01.01.2006 is to be brought corresponding to the revised pay scale as per 6th Central Pay Commission and then it has to be ensured that pension fixed is such that it is not lower than 50% of the minimum of the pay in the band and the grade pay thereon. As a result, all these petitions succeed and mandamus is issued to the respondents to re-fix the pension of the petitioners accordingly within a period of two months and pay the arrears of pension within two months. In case, the arrears are not paid within a period of two months,it will also carry interest @ 9% w.e.f. 01.03.2013. There shall, however, be no order as to cost.

    VETERANS TO GHERAO MP's

    Dear Veterans,
    On the 46th day of HUNGER STRIKE, 16 vets fm LUDHIANA ( Punjab), 11 vets fmJHAJJAR ( Haryana) and 5 retd Offrs total 32 vets sat on H S. To day audience str was 150 including 6 ladies. I addressed,and introduced AFVAI and requested all JCOS /ORS and Hon commissioned Offrs to join AFVAI .As Maj Gen SATBIR Sir told me there is some indication that DM may call us any time tomorrow for meeting.
    In the morning Maj Gen SATBIR has sent a mail to all MPs,DM and Hon.PM and warned them,If OROP not implemented immediately we will be forced toGHERAO all MPs in their residence.


     
     As I am getting calls, People fm Punjab will join AFVAI in a big str.theyhave demanded 25000 membership forms for three districts BATHINDA,SANGRURAND LUDHIANA. And Other districts like GURDASPUR ,FARIDKOT,FEROZEPUR and MOGA also in my contacts.For your info it good start for our AFVAI.My aim is to enrol min 1 Lac ( 100000 )                   G S SIDHU

     VETERANS TAKE OROP ISSUE TO INTERNATIONAL ATTENTION
    CHANDIGARH: After holding a hunger strike outside the Indian embassy in London on Vijay Diwas marking the Kargil victory on July 26, Punjabi NRIs are planning a worldwide campaign to press for the implementation of one rank one pension (OROP) for retired armed forces personnel from mid-August.
    Several NRIs from the UK, US and some parts of the Middle East are already on board to highlight the issue in their countries in a bid to garner international support and put pressure on the Indian government to "honour its promise". Prime Minister Narendra had raised hopes of the war veterans by promising to implement OROP during the 2014 Lok Sabha election campaigning.
    London-based NRI Harpreet Singh said, "Our veteran soldiers have been sitting on relay hunger strike for over a month now in support of OROP. They are asking the government to give a concrete timeline. NRIs all over the world are concerned and feeling pained about the developments and therefore thought of coming together in support of the soldiers."
    "A detailed schedule for a widespread campaign in different countries is being finalized before launching it in two weeks as there is strong sentiments on the issue among NRIs settled in different countries. In fact, NRIs from other Indian states too are joining in. We have made an appeal to every NRI to support our veterans and join this campaign in support of OROP in big numbers," said Dr Gurmeet Singh, another Punjabi based in London.
    "We have written open letters to Prime Minister Modi, besides running a social media campaign on Twitter to highlight the issue with all the details that one needs to know about the history of OROP. For instance, in March 2015 the government committed that OROP will be implemented in three months. But there is still no sign of it," added Jagdeep Lohan, who is supporting the cause in the UK.
