Dear MBC, Its nice of you to provide the calculator but it is observed that the basic pension as on 01.01.2006 is taken from table of 547 which was never implemented for PBORs but by CP which is different in all cases, refer PCDA 397 for that figure. Further check PCDA 551, para 3 to calculate service pension upto max.term of engagement that comes equal to basic pensions equal to that of 568. Ex- JWO 9992022018

The 7th CPC order has been issued by the PCDAs on 31.10.2016 and the ready reckoner has been released for the arrears of pre-2006 pensioners. What are the PDAs waiting for? Are they not ready when it was declared earlier. This goes to show the LETHARGY OR NEGLECTED VIEW towards the Armed Forces. What the PDAs expect the pensioners to do ? Are they waiting for the soldiers to approach them ?? If their wish is so for the implementation, let them demand it openly. I came to know that the Government pays to the PDAs exclusively (Rs. 12.00 per each transaction) for maintaining pension records of the Armed Forces. If it is so, this process may be withdrawn from the banks/PDAs and be entrusted to qualified wards of ex-sm.
Sirs I am a senior veteran. I draw my pension through the Kunnamangalam Br. Of SBT. I like to bring the following serious matter to you knowledge for expeditious action. You are, no doubt, aware of the explosive situation arising out of the unfortunate suicide of a veteran Sub. Ram Kishen Grewal a couple of days ago. Whatever may the true reason for the extreme step by the veteran both Govt. and the PDA ie the Bank, stand accused for the incident. The delay in executing beneficial financial awards by the govt concerning Ex servicemen usually get delayed at different stages at different authorities like PCDA P/PDAs and other authorized agencies. I am not imputing libel or motive to anyone but the fact remains that there have been treatment akin to callousness and outright contempt by agencies concerned when it come the matter of benefits to veterans. The referred to circular by PCDA dtd 13-10 16 has been lying with all banks since over 3 weeks. HDFC Bank and some other banks have made the payments but the Giants in Banking sector like SBI, SBT etc have not done so till date. Similarly the payment instruction for revision and arrears of 7 Cpc also had been issued but remains unexecuted. Actions of these kind create much resentment among veterans which has direct effect on serving soldiers also. This affects the morale of forces fighting at the border. The situation at border is very grave and anything which plays with the morale and confidence of troop will lead to unimaginable disaster. Please instruct your staff to expeditiously execute action on circular 568 and order on 7 Cpc and avoid more unfortunate incidents happening due to negligence from your end. Para 1.Hon'ble High Court of Delhi judgement on WP No 1535/2012 in respect of OA no 655/2010 and WP No. 2348-49-50/12 that "The fixation of pension will be subject to the provision that the revised pension, in no case, shall be lower than 50% of the sum of minimum of the pay in the pay band and the grade pay there of corresponding to the pre revised pay scale from the pensioner had retired. "This would clearly mean that the pay of retiree i.e. who retired before 01.01.2006 is to be brought corresponding to the revised pay scale as per 6th CPC and then it has to be ensured that pension fixed is such that it is not lower than 50% of the minimum of the pay in the band and the grade pay thereon. Para 2.However, vide GOI letter No 38/37/08-P&PW(A) dt 28-1-2013 which provided for stepping up of pension of pre-2006 pensioners wef 24 Sep 2012 instead of 01-01-2006. GOI appeals in Delhi High Court and subsequent appeal in Hon'ble Supreme Court vide WP No.23055/2013 and No 36148-49-50/2013 filed against said order dt 29 Apr 2013 of Hon'ble Delhi High Court have also been dismissed.Para 3. "Vide GOI,Min of Pers,PG & Pensions, Dept of Pensions and Pensions Welfare letter No 38/37/08-P&PW(A) dt 30 Jul 2015, para 4 said "Accordingly, in compliance with the above judicial pronouncements, it has been decided that pension/family pensioners may be revised in accordance with this departments OM No 38/37/08-P&PW(A) dt 28 Jan 2013 wef 01.01.2006 instead of 24 Sep 2012.Further it said vide para 5, in case the consolidated pension/family pension calculated in the manner indicated in the OM dated 28--1-2013, the same (higher consolidated pension/family pension) will continue to be treated as basic pension/family pension.Para 4. I would request to read the judgements and GOI letters issued by PMO/MOD and do not depend on CDA(P) Circulars which can be twisted and wrong statements.I am possessing these Court Judgements and GOI letters referred in. CDA(P) Circulars No 397, 430,501, 547, 549,567,568 are co-related. Hon'ble SC/Delhi HC judgements dismissed GOI appeals and clarified Govt orders issued for Pension wef 24 Sep 2012 are to be implemented wef 01-01-2006. Similarly JCOs pension granted from 01 Jul 2009 is also to be effective from 01-01-2006 as this scale was operative on 24 Sep 2012. Therefore difference of 24 Sep 2009 and 01-01-2006 are the arrears for pre-2006 JCOs pensions.
NS Gill ji, Subedar Raghbir Singh of "y"group 28 years service. His basic pension before 1.7.2009 is rs.10532/-wef 1.1.2006. Rs 11970/- wef 1.7.2009. Pension as per circular 547 is 9440/-wef 1.1.2006.He is not entitled for any arrear from 1.1.2006 to 30.6.2009 since he is already drawing basic 10532/- which is more than rs.9440/-which was minimum guaranteed pension wef 1.1.2006 vide circular 547.
In case pension wef was Rs.10532 even then he is eligible Rs. 11970 wef 01.01.2006. His arrears will be Rs. 11970-10532=Rs.1438 Arrears.Rs.66177=00.Delhi High Court judgement and PMO/MOD letters ref. PCDA(P) circulars cannot over rule to Govt orders and court judgements. Hence irrelevant.
Indian Constitution Fundamental Rule 14 is applicable for equalising pension of Rs. 11970 for all Subedars of Y Group with 28 years service. How, he can be paid less pension of Rs. 10532? Rs. 9440 is Minimum Guaranteed Pension(MGP) even to Subedar with 15 years service directly granted commission as Nb Sub and not for Subedars with 28 years service. Where it is mentioned that pension cannot be more than Rs. 9440 MGP?

Govt should think about maximum pensions and salaries also. Many citizens of India drawing the pension of Rs 1,000/-pm and salary of Rs 5,000/-pm also living . This much of financial discrimination is not good for economy.

Sub Raghbir Singh served for 28 years in "Y" Group. His pension was Rs. 11970 p.m. wef 01 Jul 2009 vide Table 5(Army) attached to GOI, MOD, DESW letter No 1(13)/2012/D(Pen/Policy) dated 17 Jan 2013. This letter was fwd by P CDA(P) Circular No 501. This pension scale was not changed wef 24 Sep 2012 as it was maximum of Sub scale of Pay of Rs.23940 p.m.SAI 1/S/2008 ref.As per Hon'ble Dehli High Court judgement pensions granted wef 24 Sep 2012 are to be from 01.01.2006. Hence the difference of amount is arrears of Rs. 66177. My mobile No 09876188868.

I had already spent a lot of time and money in making the correspondence/RTI to get the same arrear with similar case quoting the above authority but could not get due to MOD letter dated 3.9.2015. Disclose your identity and mail me your particulars, hiome address, your service details etc. I will guide you clearly about legal and normal implications in getting dues and arrears. In case any ex serviceman is not in a position to remember his basic pension on 01 Jan 2006 which was revised on 11 Nov 2008 vide GOI, MOD letter No 17(4)/2008(1)/D(Pen/Policy) dt 11 Nov 2008.No PPO are received by ESM till today. These are lying with PDA/CPPC/DPDO/Records Offices. How do individial ESM remember what was paid to him on different dates viz 01 Jan 2006, 01 Jul 2009, 24 Sep 2012, 01 Jul 2014(OROP) and now 01 Jan 2016(7 CPC). These scales are available in different Govt letters/reproduced in PCDA(P) Circulars. Even if ESM claim wrong figures, the correct details are available with CPPC/DPDO/PCDA(P) SANGAM Cell/A&T Wing. One should claim maximum amount, let Govt agencies come out with correct details or provide copy of PPO. I all these details with me and calculation charts correct from all angles as I have maintained all Govt letters/Circulars/Court judgements from internet(www/pcda(p).nic.in). I had 30 years DA calculation details from 01 Jan 1986. I had ready hand arrears(incl DA) details of 6th CPC. You should know some details and remaining your Personal Computer provides but you should know how to get these. Best of luck, no more questions and answers without your personal ID, service details, home address, bankers/DPDO etc/mobile & e-mail.
As per 7th cpc pension revision order the Disability pension revision has been referred to anomaly committee. Now the PDA give us the prerevised rates as I presume. If so what percentage of DA will they give for prerevised Disability rates. please let me know if anybody have any idea.
Though 7th cpc on pension has been issued by both govt and cda pension there is no sign of releasing the amount. DL 33 arrears and pension arrears are to be paid. Many have to prepare IT Form 10E for income tax exemption under para 89(1). Hope govt will release the amount immediately.

Orders were issued for delinked pension and the 7CPC Option 2 pension and DR increased by 2%. None of these were attended to by the PDAs till now. Orders are clear that action to disburse modified pensions with arrears must be arranged immediately on GOI Orders without waiting further departmental orders. The PDA staff cannot delay dispensing pensions and arrears as they are not part of the demonetizing scheme of the concerned banks.
I came to know that 3 Banks branches have started disbursing 7th CPC Pensions+Arrears. Others will follow and by 30 Dec 2016 every defence pensioner will get his 7th CPC pensions+Arrears+DA 2 % increase..

While calculating arrears, DA at six monthly slabs is included and then only arrears are multiplied. Rest assured, P CDA(P) Audit and Technical Wing had trained all Banks Central Pension Processing Cells/Centres, Regional CDA PD/DPDOs to do the needful. WORRY NOT PLEASE for calculations/DA rates.

Inclusion of the DOB (Date of Birth) of Spouse in the PPO of the soldier's/airmen and sailors by using Aadhaar as a reference by the PDAs.
I understand that many widows are not getting the pension/arrears just because their Date of Birth is not reflected in the original PPO. Consequently they have to run around the PCDA (P), Record Office, AG Branch AHQ, the PDA with no solutions in sight. I too faced the problem and suffered for the last two years. As a last resort I approached my bankers to include my Spouse's name in their system and they did it in a jiffy on my giving them my Spouse's Aadhaar number from which they got her DOB confirmed.
This information will be of help to all widow pensioners of the Armed Forces. More over all soldiers too can include their Spouse's DOB if they are not included in their PPOs.

Dear all, good job done in bringing to light the problems relating to ex-servicemen vis-a-vis modalities for calculating different type of arrears. If the DDOs do not give in writing the yearwise breakup of arrears paid during FE 2016-17 than how the income tax authorities will accept the view presented by assessees with regard to the amount due and paid to pensioner on account of different type of arrears. ReplyDeletePara 1.Hon'ble High Court of Delhi judgement on WP No 1535/2012 in respect of OA no 655/2010 and WP No. 2348-49-50/12 that "The fixation of pension will be subject to the provision that the revised pension, in no case, shall be lower than 50% of the sum of minimum of the pay in the pay band and the grade pay there of corresponding to the pre revised pay scale from the pensioner had retired. "This would clearly mean that the pay of retiree i.e. who retired before 01.01.2006 is to be brought corresponding to the revised pay scale as per 6th CPC and then it has to be ensured that pension fixed is such that it is not lower than 50% of the minimum of the pay in the band and the grade pay thereon. Para 2.However, vide GOI letter No 38/37/08-P&PW(A) dt 28-1-2013 which provided for stepping up of pension of pre-2006 pensioners wef 24 Sep 2012 instead of 01-01-2006. GOI appeals in Delhi High Court and subsequent appeal in Hon'ble Supreme Court vide WP No.23055/2013 and No 36148-49-50/2013 filed against said order dt 29 Apr 2013 of Hon'ble Delhi High Court have also been dismissed.Para 3. ReplyDeleteCDA(P) Circulars No 397, 430,501, 547, 549,567,568 are co-related. Hon'ble SC/Delhi HC judgements dismissed GOI appeals and clarified Govt orders issued for Pension wef 24 Sep 2012 are to be implemented wef 01-01-2006. Similarly JCOs pension granted from 01 Jul 2009 is also to be effective from 01-01-2006 as this scale was operative on 24 Sep 2012. Therefore difference of 24 Sep 2009 and 01-01-2006 are the arrears for pre-2006 JCOs pensions.
ReplyDeleteNS Gill ji, Subedar Raghbir Singh of "y"group 28 years service. His basic pension before 1.7.2009 is rs.10532/-wef 1.1.2006. Rs 11970/- wef 1.7.2009. Pension as per circular 547 is 9440/-wef 1.1.2006.He is not entitled for any arrear from 1.1.2006 to 30.6.2009 since he is already drawing basic 10532/- which is more than rs.9440/-which was minimum guaranteed pension wef 1.1.2006 vide circular 547.
ReplyDeleteIn case pension wef was Rs.10532 even then he is eligible Rs. 11970 wef 01.01.2006. His arrears will be Rs. 11970-10532=Rs.1438 Arrears.Rs.66177=00.Delhi High Court judgement and PMO/MOD letters ref. PCDA(P) circulars cannot over rule to Govt orders and court judgements. Hence irrelevant.
DeleteIndian Constitution Fundamental Rule 14 is applicable for equalising pension of Rs. 11970 for all Subedars of Y Group with 28 years service. How, he can be paid less pension of Rs. 10532? Rs. 9440 is Minimum Guaranteed Pension(MGP) even to Subedar with 15 years service directly granted commission as Nb Sub and not for Subedars with 28 years service. Where it is mentioned that pension cannot be more than Rs. 9440 MGP?

Govt should think about maximum pensions and salaries also. Many citizens of India drawing the pension of Rs 1,000/-pm and salary of Rs 5,000/-pm also living . This much of financial discrimination is not good for economy.

ReplyDeleteSub Raghbir Singh served for 28 years in "Y" Group. His pension was Rs. 11970 p.m. wef 01 Jul 2009 vide Table 5(Army) attached to GOI, MOD, DESW letter No 1(13)/2012/D(Pen/Policy) dated 17 Jan 2013. This letter was fwd by P CDA(P) Circular No 501. This pension scale was not changed wef 24 Sep 2012 as it was maximum of Sub scale of Pay of Rs.23940 p.m.SAI 1/S/2008 ref.As per Hon'ble Dehli High Court judgement pensions granted wef 24 Sep 2012 are to be from 01.01.2006. Hence the difference of amount is arrears of Rs. 66177. My mobile No 09876188868.

I had already spent a lot of time and money in making the correspondence/RTI to get the same arrear with similar case quoting the above authority but could not get due to MOD letter dated 3.9.2015. No more conversation with you since you are adament and do not want to understand and read MOD letter St 3.9.2015.

Disclose your identity and mail me your particulars, hiome address, your service details etc. I will guide you clearly about legal and normal implications in getting dues and arrears. I cannot deal with unknown people as my identity is known in CDGA/P CDA(P) CDA(PD), Banking circle. I got my arrears, my broad banding disability and my promotion case in court. I am not adament whereas you do not want to disclose your ID.

ReplyDeleteIn case any ex serviceman is not in a position to remember his basic pension on 01 Jan 2006 which was revised on 11 Nov 2008 vide GOI, MOD letter No 17(4)/2008(1)/D(Pen/Policy) dt 11 Nov 2008.No PPO are received by ESM till today. These are lying with PDA/CPPC/DPDO/Records Offices. How do individial ESM remember what was paid to him on different dates viz 01 Jan 2006, 01 Jul 2009, 24 Sep 2012, 01 Jul 2014(OROP) and now 01 Jan 2016(7 CPC). These scales are available in different Govt letters/reproduced in PCDA(P) Circulars. Even if ESM claim wrong figures, the correct details are available with CPPC/DPDO/PCDA(P) SANGAM Cell/A&T Wing. One should claim maximum amount, let Govt agencies come out with correct details or provide copy of PPO. I all these details with me and calculation charts correct from all angles as I have maintained all Govt letters/Circulars/Court judgements from internet(www/pcda(p).nic.in). I had 30 years DA calculation details from 01 Jan 1986. I had ready hand arrears(incl DA) details of 6th CPC. You should know some details and remaining your Personal Computer provides but you should know how to get these. Best of luck, no more questions and answers without your personal ID, service details, home address, bankers/DPDO etc/mobile & e-mail.

DeleteThough 7th cpc on pension has been issued by both govt and cda pension there is no sign of releasing the amount. DL 33 arrears and pension arrears are to be paid. Many have to prepare IT Form 10E for income tax exemption under para 89(1). Hope govt will release the amount immediately.

ReplyDeleteOrders were issued for delinked pension and the 7CPC Option 2 pension and DR increased by 2%. None of these were attended to by the PDAs till now. Orders are clear that action to disburse modified pensions with arrears must be arranged immediately on GOI Orders without waiting further departmental orders. The PDA staff cannot delay dispensing pensions and arrears as they are not part of the demonetizing scheme of the concerned banks.
ReplyDeleteI came to know that 3 Banks branches have started disbursing 7th CPC Pensions+Arrears. Others will follow and by 30 Dec 2016 every defence pensioner will get his 7th CPC pensions+Arrears+DA 2 % increase..

While calculating arrears, DA at six monthly slabs is included and then only arrears are multiplied. Rest assured, P CDA(P) Audit and Technical Wing had trained all Banks Central Pension Processing Cells/Centres, Regional CDA PD/DPDOs to do the needful. WORRY NOT PLEASE for calculations/DA rates.

ReplyDeleteInclusion of the DOB (Date of Birth) of Spouse in the PPO of the soldier's/airmen and sailors by using Aadhaar as a reference by the PDAs.
I understand that many widows are not getting the pension/arrears just because their Date of Birth is not reflected in the original PPO. Consequently they have to run around the PCDA (P), Record Office, AG Branch AHQ, the PDA with no solutions in sight. I too faced the problem and suffered for the last two years. As a last resort I approached my bankers to include my Spouse's name in their system and they did it in a jiffy on my giving them my Spouse's Aadhaar number from which they got her DOB confirmed.
This information will be of help to all widow pensioners of the Armed Forces. More over all soldiers too can include their Spouse's DOB if they are not included in their PPOs.
Hi My father retired in 1968 as Fl/Sgt, present basic is 8740/- what would be his 7 cpc pension. Plus another query, if this de linking of 33 years of service will any additional arrears as per orop would be given.

ReplyDeletegood job done in bringing to light the problems relating to ex-servicemen vis-a-vis modalities for calculating different type of arrears. If the DDOs do not give in writing the yearwise breakup of arrears paid during FE 2016-17 than how the income tax authorities will accept the view presented by assessees with regard to the amount due and paid to pensioner on account of different type of arrears. Similarly , how will we modify our IT return in absence of a written certificate by the PDAs ( DPDO OR BANKS )
