    ONE MAN JUDICIAL COMMISSION APPOINTED TO LOOK IN TO THE ANOMALIES IN OROP

    1. Hope that Justice Reddy understands Kshiyari Commitee report and the OROP as accepted by both the houses of the Parliament. His recommendations must be hailed as fitting welfare measure for soldiers of the forces for ages. Lastly we hope that the government will obtain from tutering him.

    2. TheESM were slow in their actions and have to pay a heavy price. Now by notifying the one man judicial commission, the government scored a point and the ESM's hand are bound, they cannot approach the SC for intervention/justice. At Least now onwards the senior ESM must keep themselves alert and watch/help the committee from time to time keeping proper coordination with the ex servicemen to cell at Defence ministry. Justice Reddy got only few documents to examine to arrive at the natural justice to the ESM. 1. The Koshiyari committee report, 2. The GoI notification on OROP, 3. GOI clarification on PMR, 4. 7th CPC recommendations for the defence service personnel, and lastly 5. The ESM's current objections to the government's steps in implementing OROP. He must not get uttered by the bureaucrats of the defence/finance ministries and mainly depend on points brought about the OROP by various intellects from time to time in the media in the last two years or so. The morale of the soldier, his honour and dignity must be protected at any cost to the nation, for these three are the life lines fora soldier. If his attitude is to slight the soldier for petty egos of the bureaucrats and their political bosses, then the nation will suffer in the long run drastically.

    5. The judicial commission should go through from koshiyari committee recommendation & approval by two parliaments based on which DGL prepared by Service HQs then objections raised by veterans. In that situation only Justice Reddy Sir will be able to finalize it in a correct man er.

    6. Since koshiary committee recommendation and approval of two parliaments are there this omjc is unwarranted. However hope justice reddy sir will do justice towards veterans

      Sub: - OROP Anomalies: Regarding
      I have the honour to submit the following for your kind consideration and favourable decisions on the subjected matter since the One Man judicial commission asked like me veterans to bring forward any anomalies in the OROP.
      1. The One Rank One Pension means, let me quote the sentence in the letter No 12(01)/2014-D(Pen/ Pol )-Part-II, Ministry Of Defence (department of Ex-servicemen welfare the second Para says “Whereas it is necessary to implement the same in an equitable manner keeping in the view the existing pension structure, the condition of service, the reason for varying pensions’ in case of service personnel of the same rank with length of qualifying service retiring at different points of time as well as the principle og OROP decided by the Government vide Govt of India letter No.12(1)/2014/D(Pen/Pol)/Part-II dated 7.11.2015”
      2. Where as the OROP declared and implemented and per Circular 555 ignoring the concept of OROP. Same pension is granted a Nb Sub, 15 and 22 yeas qualifying service not taking consideration the laters 7 years more numbers of service. Like so many rank holders are being paid same pension/family pension not considering the number of years served by the individual. Ordinary soldiers pension granted in OROP is same for 8 years to 28 years service i.e Rs.4, 287/-.
      3. There are highly skilled technicians like Aircraft, Submarines technicians etc these highly skilled technicians in all walks of life in the armed forces are ignored. For example the only security duty person Dsc (I am not belittling their duty) with the same rank in being paid the same pension taking into consideration only the rank held.
      4. Apart from pay band the grade pay, Trade pay and Military service pay are considered to sanction pension, i.e 50% of the last drawn pay after 6th PC w.e.f 1/1/2006. Once equate the pension with the ordinary soldiers without any skilled job like the Grade, Technical pay etc are nullified.
      5. The wide gap in the Pay and allowances structures between Officers and Men to be brought down. Like MSP is recommended to Officers is Rs.15,000/- where as it is only Rs.6,000/-(7 PC) to men not taking into consideration of JCOs (Junior Commissioned officers).During 6th PC also the initial recommendation was Rs.6000/- for officers and Rs.1000/- for men, later objections were raised from different parts it was hiked to Rs.2,000/-
