    1. Many AFTs in their verdicts ruled out that pension enhancement to pre-2006 Hony Commissioned Officers should be effective from 01.01.2006, but the Govt has again deceived the veterans by giving the benefits from 24.09.2012.It is a unfortunate decision. Should be re-looked.

      Honorary Officers of armed forces were given less pension due to wrong interpretation of 6th CPC orders. So, the Government should consider making the increased pension from 1.1.2006, instead of 24.9.2012 as the Govt. authorised increase of pension for Hony. Fg Offrs of Air Force from 13,500/- to 13,590/- to be at par with his junior who was paid higher pension with effect from 1.7.2009, the day junior MWO was paid higher pesion.

    5. now delhi high court vide their judgement dt 29.04.2013 have indirectly (i.e in the language of law) hinted that the pension increase should be effective from 01.01.2006 instead of 24.09.2012. Am I correct ? please confirm

    6. THIS IS FOR CENTRAL GOVT.PENSIONERS ONLY, ex-servicemen are governed by a notification issued by ministry of deference.Even for central government pensioners having less than 33 years service, full parity is from the date of gazette notification.However we can
      expect form the date of notification of cabinet resolution of pay revision(2008).

    7. exservicemen are also comes under central govt pensioners category. cabinet resoluation of pay revision (2008) is effective from 01.01.2006. hence pension increase should be from 01.01.2006 instead of 24.09.2012. kindly confirm its correctness. thanks.

Sir, the question arises as to from which date the enhancement of pension of pre 2006 pensioners should have been effected, since the anomaly to the original orders i.e 6th cpc implementation when rectified should be from its original date i.e from 01.01.2006 and not from 24.09.2012. please clarify

AS per the cabinet resolution accepting the recommendation of 6th CPC ,enhancement of pension for pre-2006 pensioners should be effected from 01/01/2006 for all except pensioners having less than 33 years qualifying service.Full pension in other words 50% of basic pay as pension is allowed to pre -2006 pensioners only w.e.f.29/08/2008 as per SL.NO.3 of cabinet resolution(PLEASE REFER CABINET RESOLUTION GIVEN IN THIS BLOG AS LINK)

    11. Sir, thanks for prompt response. Kindly clarify whether 33 years of qualifying service includes weightage of 5 years for defence pensioners as per normal rules. If this is so, then the enhancement of pension should be from 01.01.2006 instead of 24.09.2012.

As per CCS pension rules 1972 amended from time to time ,those who are completed 28 years of qualifying service and having 5 years of left over service are eligible for 33 years of pension.Hence they are eligible for parity w.e.f 01/01/2006.This is applicable to central govt civilians & defense personal(The special weightage given to ex-servicemen rank wise is not counted for this purpose)

Sir, my real query is like this. vide MOD letter No 1(13)/2012/D(Pen/Policy) dt 17.01.2013 cut off date for improvement of pension of pre 2006 PBOR has been given wef 24.09.2012, whereas while rectifying the anomaly to the original orders i.e 6th cpc recommendation the same should have been given retrospectively ie from 01.01.2006 instead of 24.09.2012 as per standing rules/regulations. kindly confirm whether am I correct? thanks

    14. The MOD has not rectified the anomaly in the recommendation of 6th pay commission. What ever arrears we got vide the above letter was an enhancement of pension aiming gradually towards one rank one pension & not modified parity.Since this benefit was given out side the recommendation of 6th CPC the effective date was given as per convenience of GOVT.The MOD has no intention to rectify the above anomaly.Modified parity is a common demand by all central govt pensioners including ex-servicemen.At present the case is in supreme court & if we get a favorable verdict,it will beas per recommendation of 6th CPC

    15. As per 6th CPC, pension of Hony Commissioned Officers (Pay Band 3) was fixed at Rs 13850/- (Hony Capts) and Rs 13500/- (Hony Lts) wef 1.1.2006. Prior to 2006 Hony Commissioned Officers pay scale was a fixed one i.e Rs 10800/- (Capts) and Rs 10500/- (Lts). As per pay fixation formula of 6th CPC, the existing pay of Hony Capts and Lts as on 01.01.2006 was to be taken into account and it should be multiplied by 1.86+Grade Pay and Military Service Pay (MSP)to be added to it. Accordingly the maximum pension for the fixed scale Rs 10850/- and Rs 10500/- works out as Rs 16145/- and Rs 15465/- p.m for Hony Capts and Lts respectively, whereas they were fixed with a maximum pension of Rs 13850/- and Rs 13500/- p.m only. Now vide MOD letter dt 17.01.2013 pension of Hony Capts and Lts has been correctly refixed at Rs 16145/- and Rs 15465/- respectively. Thus there seems to be rectification of anomaly to the original orders of 6th CPC while fixing the pension of Hony Capts and Lts and that should be effective from 01.01.2006 and not from 24,09.2012.     17. Dear Sir,
      The 6th CPC has not recommended fixation of pay of pre-2006 PBOR W.E.F.01/01/2006.Please refer cabinet resolution dated 29/08/2008
      by which cabinet approval is given to some of the recommendation of 6th CPC & published in gazette.If you refer recommendation Sl.No.3 in the gazette you can see a word except PBOR. Hence PBOR can not claim parity w.e.f.01/01/2006 as per the above recommendation.

Dear Sir, GOI, MOD letter No 17(4)/2008(1)/D(Pen/Policy) dated 11.11.2008 is based on resolution No 38/37/08-P&PW(A) dated 29.08.2008 wherein the Govt decision on the recommendations of the 6th CPC for revision of pension of Pre 2006 Armed Forces Pensioners/Family Pensioners wef 01.01.2006 have been fully explained. As such the Govt orders dated 17.01.2013 rectifying the pension fixing anomaly of Hony Commissioned Officers should be effective retrospectively i,e 01.01.2006. Thanks

    19. Dear Sir,
      The said resolution No 38/37/08-P&PW(A) dated 29.08.2008 doesn't contain any reference to the payment of enhanced pension to pre-2006 PBOR pensioners w.e.f 01/01/2006.The benefit under MOD letter dated 17/01/2013 is not granted as per the contents of above resolution.It is given as a special benefit by adding 2 years special weightage which is not mentioned in the resolution.
      Hence it can not be effected from 01/01/2006

    21. The implication of this judgement is not the applicability of enhancement of pension of pre2006 pensioners circular dated 24/09/2012 w.e.f.01/01/2006. This is a wrong perception.The implication of this judgement is that the parity of pension of pensionpre2006 pensioners with post 2006 pensioners & arrears to be paid w.e.f. 01/01/2006

        The pension enhancement circular dated 28/01/2013 gives only a megre amount of enhancement of pension, some times it may not even effect an increase in your pension.This circular doesn't give you full parity with post 2006 pensioners.Now you tell me whether you want to implement this circular w.e.f.01/01/2006 ,I am sure that you will not agree.Please understand what CAT-PB & DHC has ordered is full parity of pension to pre-2006 pensioners as applicable to post 2006 pensioners & arrears to be paid w.e.f.01/01/2006.

      I retired from IAF in the rank of SGT ON 30-04-2001 on completion of 20 years of service and held in the rank for 09 years 11 months. Now I would like to know whether ACP/MACP will be applicable/consider while calculating my pension as the same is effected for the post 2006 retirees.

Respected Sir, Kindly help our MNS those who have completed Training for Three years in our Tricolor service after successfully completion of their training period,they awarded as an officer Rank by our Government, in this case ,we should stand behind of those sacrifice their life after their school studies and completed their training in our tricolor service after that they become commission as an officer , they cared our Jawans and officer and their children ,wife's and our family.if we think little bit,they also in our family member like our ladies(younger/elder sister) doing nursing duty for our tricolor service person and officer those who sacrifice their life to our Nation.if those MNS who completed minimum ten years after their training period as a commission officer, they should be consider as a pensioner and we should make sure that,they also should get minimum pension as their rank concern. In our CSD order for our benefit,those who have served minimum six months in our tricolor service ,they can avail the benefit of CSD like wise those who completed ten years of Nursing service for our Jawans and officer and their families,they also should get pension benefit. in civil side if compare all the person, they have union and they fight for their right and benefit for each and every body and even their Luscar also.But in our tricolor service MNS is not a Luscar. in cinema field they also looking after their co-actress and co-actor welfare for minimum pension,then why don't we should consider our MNS ,who served at least minimum ten years with us for us and our families. please Sir, help those who have sacrifice their life for our family and Nation.sir please consider.
