AFRO REJECTS PENSION FOR LAST RANK HELD

Dear Sir,
I am a defence (Air Force) pension beneficiary vide PPO-08/14/B/14315/2005 dt.01 Dec 05 {(Sr. No.696720-H, Ex-JWO but with a pension of Sgt ‘X’ Gp.)
& Pension account no.3709000 0100502160 of PNB, Sahibabad,
Ghaziabad-201005 (UP). I was released from Air HQ(VB) as JWO on 30 Nov
2005.
In
reference to several Armed Force Tribunal directives, the pensions have
been revised to JWO's rank pension to many a cases like me who held the
rank of JWO lesser than ten months also(some cases received an arrear
with 8% interest also). As mandated, the pension should have been
granted on the basis of last rank held for whatever period. However, I
have neither been paid the revised pension according to the above said
revision or received any intimation from PDAs till date.
A letter attached from AFRO would reveal that a clarification sought
afterwards also cleared SGT pension only with revision of weightage.
I have been debarred of this benefit for year. May
I know the reason for indifference? Do each individual need to approach
AFT pleading his case? I believe, if a directive is passed it should be
implemented for all affected cases. I hope, if not done timely the OROP
pension revision would also be affected and based on SGT pension only
in place of JWO, which would again require correction.
Therefore,
I request you to kindly look into the issue and instruct suitably to
revise the pension & make payment of the arrears at the earliest.

1. Please refer your e mail.
2. As per para 122 of Pension Regulations for the Air Force 1961 (Part -I). "Except as otherwise provided for, service pension is assessed on the lowest rank and lowest group held by an individual during the last ten months of his qualifying for pension". Further as per para 123, "A competent authority may condone a deficiency of service on a particular rank not exceeding three months, except on voluntary retirement". It is intimated that existing Govt. rules, condonation beyond three months in last rank service is not feasible. It is also intimated that the extent policy is not being amended or superseded till date in respect of Pre-06 pensioners."
3. It is intimated that all of you have not completed a minimum period of 10 months service as JWO and hence entitled for Sgt rank pension which is correct and in order as per policy in vogue.
4. It is also intimated that the various AFTs are passing orders on the basis of AFT(PB) New Delhi judgement dated 29 Jan 2010 passed in TA No. 339/2010 filed by Ex JWO Bharat Singh Khatana Vs UOI and others. It is pertinent to mention here that the AFT(PB) New Delhi Court order dated 29 Jan 2010 has been challenged before the Hon'ble Supreme Court of India and the case is pending for adjudication.
