    Government agrees to implement the judgement of CAT

    Government has agreed to implement the judgement of the CAT within one month for grant of full Pension to Pre 2006 Pensioners who retired after 10 years of service on superannuation or 20 years of service on Voluntary retirement or absorption in PSU. This commitment was given by the Government Advocate in CAT PB New Delhi during the hearing of the Contempt of Court Case filed by Shri Pratap Narayan & others -vs - Union of India.

        My father was an ex-service men retired in 1981 with 16y 1m as sep y group. Mother getting ordinary family pension 3500 basic. Is she legible to get pre-2006 arrears (2006-2012). We didn't get information sir. If yes what is the process get... and what will be the basic pension after orop implimentation.plz reply sir. Thanq

    4. Whatabout retirees served less than 20 years but sanctioned pension; for them pro rata. The theme of sixth pay commission is the basic pension in no case be less than fifty percent. Have we to fight for that upto fighting case upto apex court. NO CITIZEN, NO ARMED FORCES VETERANS ARE THE CAUSE FOR EXPENDITURE ON ACCOUNT OF LITIGATION FOR UNREASONABLE ETHICS BUT THE BEAROCARTS AND THE RULERS.THE GOVT BACKED BY BEAROCRATS HAVE RPT HAVE THE MIGHT TO FIGHT ANYTHING EITHER REASONABLE OR UNREASONABLE UNTILL APEX COURT at the cost of TAX PAYERS MONEY. Whatever the case they lost, the court should give ruling the money the cost should be recovered the pay of the politicians and bearocarts.

    5. Injustice to the pre-2006 pensioners is undone through this judgement. GOI shamelessly tried to discriminate pre 2006 pensioners and avoid legitimate payments due to them. This is a landmark judgement

    6. I am one of the victims who served in the Railway for 22 years when retired in 2004 I was given pro rata pension of Rs 3333 and revised as Rs 5022 as per 6th cpc. The decision of government to implement CAT judgement is a great relief to. Thanks for all those who were fighting for this.

    7. I served 15 years in navy in y group .retired in Jan 2004 at that time I was getting only rs. 1936.00. including da will this judgement effect our pension.

    10. With this judgement the PCDA (P) circular 555 must get simplified. In that the QS will start at 0.5 years and end at 20 years. Am I correct?

First up all I wish to say that reduce the salary of Pay Band 4 and above from existing rate to 10 % to 15 % and hike the salary of Pay Band 3 and Below from existing rate from 10 % to 15 % as recommended by Seventh pay Commission so our Country can balance the financial burden and fiscal deficit with out any problem

    18. Manohar AM sir, Judgement of CAT Principal bench DT 21 Apr 2015 is qualifying service (20 yrs) will take effect only for all government employees OTHER THAN PBORs IN DEFENCE FORCES.This is applicable to Pre-2006 & Post-2006 pensioners.

      i got discharged from IAF on fulfilling the terms and conditions of IAF, after 21 years 12 days on 31/12/1990. i am in Y group. why there is a huge variation in X & Y group Jwo's Pension, while there is marginal difference between WO & MWO, just see this:
      X : JWO WO MWO
      10480 11615 12960
      Y : 8755 11150 12385
      ----------------------------------------------
      dif: 1725 465 575
      ---------------------------------------------- and to add fuel to fire an X group Sgt is paid Rs.200 more than a Y group JWO, is it justified?

      OA 1165/2011 with OA 2165/2011 And OA 246/2012 New Delhi this the 21st day of April, 2015
      13. In view of the judgments of the Honble Supreme Court in D.S. Nakara (supra), V. Kasturi (supra), T.S. Thiruvengadam (supra) and order of the Full Bench of the Tribunal in OA 937/2010 with OA 2101/2010 dated 20.11.2014, we are of the opinion that the prayer in the OAs is fully justified. We, therefore, quash and set aside the impugned orders dated 3.10.2008 and 19.03.2010 being violative of law laid down by the Honble Supreme Court and direct the respondents that the qualifying service for earning full pension will be treated as twenty years also for those who retired from the Central Government service on or before 31.12.2005 and were alive on that day. The respondents are also directed to modify/amend all relevant government orders/ letters/ notifications in accordance with the above decision. It is made clear that this parity of pension between pre and post-1.01.2006 pensioners (on the question of eligibility of minimum pensionable service of twenty years) would apply both as regards pension and family pension.
      “For parity of reasons, the qualifying service for earning pension in case of superannuation and retirement on absorption in government body/ government undertaking will be treated as 10 years also for those who retire from the Central Government service on or before 31.12.2005 and were alive on that date.” The respondents are granted three months time from the date of receipt of this order for implementation of directions contained in this order.

      From above Judgement is based on judgement of CAT 2015 and 22-1-2016,
      The judgement does not allow 50% pension after 10 yars service.
      More over CAT Judgemet in 21-4-2015 in para4 Recommendation-3 same reproduced below:
      The recommendation regarding payment of full pension on completion of 20 years of qualifying service will take effect only prospectively for all Government employees other than PBORs in Defence Forces from the date it is accepted by the Government (6.5.3.)

      In light of above Shri Chandern Sir is requested to clarify is there any other Judgement given after 22-4-2016,if so kindly publish the Judgement.
      As per judgement reproduced above it is doubtful case for PBOR.

    22. Dear MBC Sir,
      As already commented on 18/2/2016 I have served in the railway for 22 years one month and retired on 30/4/2004 as Head Clerk in scale 5000-150-8000 and my last pay drawn was 6800+3400 thus my pension was fixed at 3333 and was revised as 5022. Now as per CAT judgement I am eligible for 7686 from 1/1/2006. Kindly enlighten me if my contention is correct. I earnestly appeal to guide me please.
