      H.C.Delhi order dt.29/04/2013
      The High Court of Delhi has issued a writ f mandamus directing U.O.I. to refix pension of pre-2006 retirees in accordance with resolution passed by Govt.
      U.O.I is said to have filed an S.L.P in Supreme Court against the Delhi high court order perhaps on the grouse that they are obliged to pay only the parties to the suit settled-not others.
      What acquires significance is that the benefit of increased pension flows to retirees by virtue of rules and no discretion rests with the U.O.I,i.e discretionary power to restrict payment to select few as against lakhs of pensioners.
      The implication is that the dues of pre-2006 pensioners(barring a few) have been blocked and appropriated by the Govt. illegally.Justice demands that either all be paid or no one.Exercise of unintended power defeats the purpose of their own Resolution(notified and acted upon in a distorted manner.This smacks of prejudice and discrimination.

      Sir, we can't understand that on which grounds UOI submits in the court that CATPb judgement implies to the applicants only whereas in the judgement nothing like that is written.

      Though I am one of the benfitiary of the arrears from 1.1.06 to 23.9.2012, I am sure in my mind I will not get anything. The BJP gives lip service to soldiers/Ex-soldiers but goes all out to block any benefit coming towards service/Ex-service personnel. Look at the amount of letters written to MOS(PP) by BPS & Others.

      The decision of the SLP heard on 16.9.2014 by the Hon,court for implementing the CAT order dated 1.11.2011 be mentioned as the Govt. willfully denying the benefit to all except the petitioners which seems to be quite illegal. Bachan coach.
