    GOI WANTS TO BUY TIME TILL GENERAL ELECTION

    Respected elders,
     Reports from ministry of finance & department of pension indicates that the GOI wants to buy time by filing another SLP in supreme court against pre-2006 pensioners .The main contention of the SLP is  on the the inability of the GOI to implement the court order due to huge financial implication. The GOI is learn t to have obtained legal opinion for the same.Their main aim of this move is to buy time till the the govt machinery is put on election mode by election commission. When the contempt petition is expected to come up for hearing in CAT PB on 25/09/2013, they are likely to  repeat the above excuse. All the pensioners associations are requested to rise to the occasion & thwart this move of the GOI.Here it is worthwhile  to mention that lakes of cores of rupees can be lost on scams like coal gate ,chopper gate& 2G  but alas.......GOI has no money for paying  few hundreds of cores of rupees to pre-2006 pensioners as ordered by court.

    1. Yes. Billions and billions of rupees have gone to individuals by way scams like coal gate, chopper, 2 G and so many unknown ones. This total payment will only a peanut compared to scam monies gone to individuals. GOI should see the age profile of pre 2006 pensioners.

    2. GOI is following delay tactics !!!
      As we are interested / affected parties, can we not file PIL petitions in Hon'ble SC / CAT to thwart such dilatory / delaying tactics by GOI ?
      Can the Legal Eagles in our fraternity help in filing such a PIL ?

    3. Government is so pretend to be very poor towards any legitimate meager payment to its Pensioners, despite repeated legal pronouncements. However, it's eyes being closed when Public funds go else where. Let the Rule of Law prevail, instead of jungle raj.

    4. Dear Sir,
      I have gone through the above note. It is correct that Govt. is avoiding to implement the judgments through which pre 2006 pensioners are benefitted . Due to such delay tactics amount is accumulated and has become difficult to pay the arrears.In such case will it not be advisable to plead to get the judgments implemented and fix the pension of pre 2006 pensioners counting 20 years as qualified service for 50% pension and rrears may be paid in instalments as it has been done in the past while implementing the recommendations of 6CPC and pay interest of 9% after 1.3.2013 as per judgment

    5. Dear Sir,
      Another SLP filed by GOI was fixed for hearing on 7.10.2013. As per above arguments could not be completed and further hearing was adjourned till 1.11.2013. But request of GOI for stay on contempt proceedings was not granted. This seems to be favourable development for pre 2006 pensioners. Now GOI should issue necessary orders as per PB CAT's verdict without any amendment before 10.10.2013.

    6. Dear Menon,
      Since the RP is dismissed by the Hon'ble Supreme court, now the UOI should issue orders for implementing the judgment of PB CAT Delhi in OA0655/2010 and the recommendations of 6CPC alreadyaccepted by he cabinet i.e. in nocase pension of pre 2006 pensioners should be less than 50% of minimum of pay band and grade pay for the existing pensioners. and 20 years for future retirees. Pl. clarify.

      I don't think that GOI will fall in line soon until they get a befitting punishment from CAT PB. Hence let us wait for 27/11/2013 when the CAT PB takes up the case again

      There are conflicting news on,merger of 50% DA with Basic pay. Whether there are orders on this issue or this is a point of reference to vii CPC. Pl. inform us the correct position.

        The union cabinet has not yet taken a decision on merger of 50% DA.The reports appearing in this regard in print & visual media is not correct.Again today on 02/03/2014 there is a cabinet meeting.This may be the last cabinet meeting before the country is placed in the election mode.Hence this is the last chance for the cabinet to approve DA merger
        & let us be optimistic
