    PRE-2006 MODIFIED PARITY CASE LATEST NEWS

    • Case Reg: MODIFIED PARITY for Pre-2006 Case W.P. 1535/2012 Reg: Appeal against Judgment of CAT Delhi (in OA 655-2010) reg. Modified Parity for Pre-2006 Pensioners, came up before a new Bench (of Hon'ble Justice Badar Durrez Ahmad and Hon’ble Justice Siddharth Mridul) at item. 13) in Delhi High Court on 17.7.2012. It was adjourned for hearing on 29th November, 2012 (as no earlier date was available with the New Bench before which the case had been enlisted).

    4. Is there any hope for full pension on 20 years of service to pre-2006 CIVIL pensioners? If so what is the present position of the case? Is any such case pending in the SC?

    5. SC's ruling is that pension of pre-2006 pensioners should in no case be less than 50% of the minimum pay in the corresponding pay band and grade pay if they have completed 20 years of qualifying service. CAT Delhi and HC Delhi's ruling is that pre-2006 pensioners with more than 20 years of qualifying service should get full pension at par with post-2006 pensioners. These judgements have not so far been implemented by the Govt.

      1. PAOs are refusing to fix pension as per High Court orders.According to PAOs all pensioners will get same pension whatsoever be their last pay drawn in pre revised scale.

    6. Sir any information about implementation of apex court orders on payment of modified parity arrears to pre 2006 pensioners wef 1.1.2006.
