Technical work / development of software towards revision of Disability pension under PCDA (P) Circular 582 is in progress.
The said revisions will be made within the time frame set over by RBI guidelines / PCDA .
4. This particular revision is likely to be done by end of this month.

Many defence staff do not follow pension norms
Many ex-servicemen and their dependents suffer due to faulty Pension Payment Order.

Major Padmapani Acharya did not know that she was entitled to one-rank
one-pension. Ms Charu Latha Acharya, wife of Maj. Acharya who gave his
life in the Kargil war, was also not getting the gallantry amount of Rs
5,000 per month from 1998 as the Pension Payment Order (PPO) did not
have the qualifying service mentioned. In another case, the 84-year-old wife of a lieutenant colonel did not
know that she was entitled to get 20 per cent additional pension as she
had crossed 80 years of age. It took her nearly a year to get her dues.
Several defence personnel do not provide the required personal data
about their spouse in the PPO. It is important to mention the year of
birth to claim the benefits. Of 40,000 defence personnel from TS, 70 per
cent are pensioners. Colonel P. Ramesh Kumar, director of the TS Sainik Welfare Board,
said, “With regard to Ms. Acharya, the PPO did not have the qualifying
service of the late Major Acharya, who died in the 1998 Kargil war.
Since then, she was not receiving the Rs 5,000 gallantry award. We had
to write to the Army and the matter was referred to the Principal
Controller of Defence Accounts, Allahabad, which issued a corrigendum.
All this could have been avoided if the qualifying service was
mentioned.” In the case of the 84-year-old, the delay in getting
additional pension could have been avoided if her birth details were
mentioned. “There are several cases wherein the ex-servicemen miss out
on important PPO details. In the recent Adalat held in the city, 932
cases related pension were reported,” he said. Air travel ID for unmarried daughters, sons: Unmarried daughters of defence personnel and sons up to the age of 25
will be issued an identification card for air travel. Apart from
pensioners, the spouse, too, will receive the air travel cards. Many dependants are ignorant of the fact that unmarried daughters can
avail pension if the parents are dead, while sons can remain dependent
till 25 years of age and avail all pension-related services. Colonel P. Ramesh Kumar, director, TS Sainik Welfare Board, said,
“Unmarried daughters of a deceased veteran and spouse are entitled to
get pension benefits if her income is less than what is entitled till
she is married. To get these benefits, the dependent’s name should be
endorsed while applying for pension, by registering with the Zilla
Sainik Board.” He said defence pensioners are entitled to exemption from property
tax. The city is home to veterans from various wars, the Sri Lankan
operation and the 1999 Kargil war.
7th Pay Commission: Good news, Pay hike confirmed, govt gives green signal
7th Pay Commission : Government gives signal for basic pay hike
The government has given the green signal to hike the minimum pay
and fitment factor beyond the recommendation of the 7th Pay Commission.
This news would come as a major relief to all Central Government
employees who have been waiting for good news and latest updates on pay
hike.
The green signal has been given to the National Anomaly Committee which
is set to meet this month. The NAC would now take up the issue.
Minimum pay hike gets green signal:
The NAC was formed to look into the pay anomalies rising out of the
7th Pay Commission recommendations. The government had assured that the
anomalies would be looked into. Now it has given the green signal to
the NAC to go ahead with the pay raise and also the fitment factor to 3
times. This would mean that the pay would be hiked from Rs 18,000 to Rs
21,000.
Government has funds:
Officials in the Ministry of Personnel, Public Grievances and
Pensions say that the government decided to give the green signal as it
had funds. The government realises that it has the funds to increase the
pay of the CG employees. This is the reason why it gave the green
signal to the NAC to go ahead and hike the minimum pay and increase the
fitment factor to 3 times.
After clearing the recommendations of the 7th Pay Commission, the
question is will the Finance Minister of India, Arun Jaitley keep up his
word on the basic minimum pay hike?
Sources say that the promise made by Jaitley will not be broken. He is
waiting for the reports by both the National Anomaly Committee as well
as the Department of Expenditure before he takes a final decision on the
matter.
Will Jaitley keep up his promise?
Sources say that Jaitley will keep up his promise on the issue relating
to the hike in basic minimum pay. During the various deliberations that
the Union Finance Minister has held on the issue, he has always
indicated that the hike in basic pay must go through.
Will NAC meet on October 7th
The all important meeting of the NAC is scheduled to be held this month.
The issue of a hike in basic minimum pay will taken up during this
meeting. A majority vote is what Central Government employees will be
expecting during this meeting. The tentative date for this meeting is
October 7th.
ECoS to examine report
Once the NAC approves the hike in basic pay to Rs 21,000 from Rs 18,000,
it would be submitted to the Department of Expenditure. This would mean
that the fitment factor will be raised to 3.00 from 2.57 times.
The report would also be examined by by the Empowered Committee of
Secretaries headed by P K Sinha who is the Cabinet Secretary. Following
this the the matter would be placed before the Union Cabinet. The
Cabinet meeting on the basic minimum pay is likely to be held in
January.
7th Pay Commission frustration to end
The 7th Pay Commission only added to the frustration of the Central
Government employees. It was bad for them in every respect. All CG
employees are now pinning their hopes on the developments to take place
in the next three months. Once the hike in basic pay is approved and the
Central Government says that it would be variable in nature, then the
hardships and frustration of the CG employees would reduce to a large

1. In the Civil Appeal No.1942/2009 Bank of India Vs K.Mohandas, Supreme Court has awarded landmark judgement of 5 Years notional weightage to SVRS – Pension optees. While many Public Sector Banks implemented the above judgement of apex court, the same has not yet been implemented in Vijaya Bank & Associated Banks of SBI.
2. In the Civil Appeal No.6013/2011 Sheelkumar Jain Vs New India Assurance Co. Ltd., the Supreme Court delivered judgement in favour of the resignee through beneficial interpretation of Pension Regulations.
3. In the WP (C) 184/2011 Federation of All India SBI Pensioners’ Association Vs Union of India, the Federation has prayed for updation of pension to SBI pensioners in line with periodical upward wage revisions of serving employees.
4. In the Civil Appeal No.2739/2007 Uco Bank Vs Rajinderlal Kapoor, the Apex Court has held that issuing Chargesheet to bank pensioners after retirement on superannuation is illegal.
5. In the WP (C) No.184/2011 - Federation of All India SBI Pensioners’ Associations Vs Union of India admitted by the Supreme Court, the Federation has prayed that:
Pension should be paid as per Pension Fund Rules calculated at 1/60th of last average 12 months pay reckoning pension service upto a maximum of 30 years without omitting any pensionable service rendered.
HIGH COURTS:
1. In the Writ Appeal No.1209/2007 G.Palani & Others Vs Bank of Baroda, Madras High Court delivered judgement in favour of the Pensioners granting payment of Arrears of Pension & Commutation to those retired between 01-04-1998 and 30-04-2005. However, Bank of Baroda management has preferred appeal through Special Leave Petition before the Supreme Court.
2. In WP (C) No.27929/2003 T.RVijayan Vs State Bank of India, Kerala High Court awarded the judgement in favour of pensioner granting 100% Neutralisation of Dearness Relief.
3. In WP No.34619/2003 Jateendranath Vs State Bank of Mysore and other related cases in WP Nos: 19267/2003, 46601/2004 & 10514/2005, Karnataka High Court gave judgements in favour of affected pensioners by ordering payment of Pension/Commutation arrears to those retired during 01-04-1998 to 30-04-2005.

4. In D.B. Civil Special Appeal (W) No. 493/2010 LIC of India Vs Asthana, Jaipur bench of Rajasthan High Court ordered LIC management to implement its own Resolution and implement uniform Dearness Relief Formula for all pensioners without any discrimination, besides updation.
5. In the WP No.37198/2001 M.C.Ratnakaran Vs Canara Bank, Kerala High Court has ordered fixation of pension as 50% of average emoluments for the last 10 months as defined in the statutory pension regulations and consequent payment of arrears of Commutation/Pension from the date of retirement till date of re-fixation.
6. In respect of WP 710/2009 Karnik Vs Reserve Bank of India it was urged before Bombay High Court for implementation of Updation of Pension as contained in the RBI Circular dated 01-09-2003.
7. In the Writ Petition No.26916/2010 - D.Arun Kumar & 56 Others Vs Canara Bank, the Officers, who were denied pension option in 2010 on account of their Voluntary Retirement from Bank’s service as per Officers’ Service Regulations, joined together and filed Writ Petition in Madras High Court seeking justice. Also a petition was filed seeking priority hearing of the case on grounds of litigants being Senior Citizens.
8. With regard to Writ Petition No.23522/2011 M.P.Ramachandran Rao & 31 Others Vs Canara Bank the Officers, who were denied pension option in 2010 on account of their Voluntary Retirement from Bank’s service as per Officers’ Service Regulations, joined together and filed Writ Petition in Karnataka High Court seeking justice. Also, it is learnt that another petition has been filed for clubbing similar cases of Officials from various banks for common hearing in the Karnataka High Court.

Pension under Regulation 95, subject, however, to fulfilling other
requirements. In that, they had not exercised the option to take
discharge on expiry of engagement (as per Section 16 of the Act of
1957) and yet were not and could not be drafted by the competent
Authority to the Fleet Reserve because of the policy of discontinuing
the Fleet Reserve Service w.e.f. 3
rd
July, 1976. The cases of such
Sailors (not limited to the original applicants before the Tribunal)
must be considered by the Competent Authority within three
months for grant of a “Special Pension” from three years prior to the
date of application made by the respective Sailor and release
payment after giving adjustment of Gratuity and
Death-cum-Retirement-Gratuity (DCRG) already paid to them from
arrears. They shall be entitled for interest @ 9% P.A. on the
arrears, till the date of payment. 26.
The appeals are disposed in the above terms with no order as
to costs. Application for impleadment is also disposed of.

New Delhi: Defence Minister Nirmala Sitharaman takes charge at her
office in New Delhi on Thursday, becoming the first full-time woman

On the first day of Nirmala Sitharaman, the first full-time woman defence minister of India, in office on Thursday, the issue of the ex-servicemen welfare was placed on the top of the agenda.
Sitharaman also signed a proposal of more than Rs. 13 crore for 8,685 ex-servicemen
"A grant of more than Rs. 13 crore will be released for 8,685 ex-servicemen, widows and dependents out of the Armed Forces Flag Day Fund," she announced.
She thanked Prime Minister Narendra Modi for considering her capable of this portfolio.
"I thank Prime Minister Modi for having vested such confidence in me and given this very portfolio to me," she said.
Talking about her priorities, Sitharaman stated, "My priority will definitely be the armed forced preparedness.
It is important that the Indian Armed Forces receives all the attention in terms of giving them every necessary endowment and equipment, which is necessary for them to perform their duty."
She further assured of clearing all pending issues in consultation with the Prime Minister Modi.
"I shall attend to all the long-ending issues and in consultation with the Prime Minister and the Cabinet and ensure that the issues that were long pending shall get resolved," the Defence Minister mentioned.
Speaking about Prime Minister's 'Make in India' initiative, Sitharaman said, "We need to have a big play of 'Make in India' in our defence production, which will be of great importance to us.
We shall ensure that the important characters of what makes 'Make in India' an important flagship programme for Prime Minister Modi is given full play for defence production, because India as you know is a very big defence equipment procurrer."
She also assured that soldier's family welfare interests would be well taken care of.
"I will not for a moment forget, that in their family's welfare, that we can ensure that the soldier at the very toughest borders, challenging zones in which they are protecting this country remain absolutely assured that their interests are being taken care of," she noted.
Sitharaman is only the second woman after late Indira Gandhi to become the Defence Minister of India, and the first one to take independent charge.
Nirmala Sitharaman took the charge today.
Indira Gandhi was additionally the Prime Minister of India when she took the office as Defence Minister.
Sitharaman previously served as a Minister of State for Finance and Corporate Affairs and the Minister for Commerce and Industry with independent charge, and now succeeds Arun Jaitley to take charge of the defence ministry.
