AN ADVICE TO THOSE WHO ARE APPROACHING THE AFT AGAINST DISCRIMINATION CONTAINED IN TABLE NO 7 & 8, DO NOT JUMP BEFORE GUN- COMPLTETE ALL FORMALITIES BEFORE FILING WRIT IN AFT

Dear Veteran friends,

Kindly treat this as a friendly advice for the benefit of all X group Veterans who are going to file Petitions in AFT for the discrimination meted to them by classifying between pre2016 & Post 2016

1) Please wait for the payment of arrears/ Pension payment by PDA’s as per the PCDA circular 666.

2) Please appeal to PSA with your grievance & wait for their reply for at leasr 30 days.

3) Please attach Copies of Pre-2016 EPPO with affidavit to AFT in which calculation is done as per notional pay method with X GP Pay as 6200 & showing more than OROP X 2.57 figure. 

4) Please Engage an Efficient Advocate well versed with ESM matters & preferably an Advocate turned ESM with a minimum 10 year Practice in AFT.

5) Please Approach Advocates in groups which may reduce your financial burden, but fee only should not be a limiting factor.

6) Since I have volunteered to Co-ordinate the cases at national level ,the Petitioner or his Advocates can collect any additional information from me at my  Email vinodvihar31@gmail.com if necessary.

7) Please do not give ears to rumours, imaginations, wrong data & interpretation.

8) Another Important Issue to be brought to the notice of the cout is that the violation of Lower & higher Rank Parity With in the homoginious group with the same length of service where by a lower rank in table No8 drwas more than a higher Rank in Table No 7.

9) The Cabinet approved & President assented  Notification issued on 04/01/2023 for the revision of OROP to PBOR envisages only one homoginious class of veterans of same rank, length of service & Group during the period of five years under revision.Creation of another group namely Post 2016 with in the above homoginious class is violation of Article of the constitution of India.

10) There are many Direct entry intakes of X GP Tradesmen recruited in Airforce Prior to 2016 Where qualification was a diploma Recognised by AICTE.

11) All the pre 2016 eligible X GP tradesmen after their training in Air force has been issued Diploma ciertificate under the authority of AICTE vide their letter No AICTE/UG/G-41 dated 10th march 2003 & they were granted an X gp pay of Rs. 1400 in 6th CPC w.e.f. 01/01/2006 consiquently all the Pre 2006 retired Veterans of the eligible X gp trade were also granted the above XP gp Pay.

The Following are the update on hearing on 09/01/2023.

AG R Venkatramani: i am personally keeping a watch and this will be rolled out shortly. there are 25 lakh pensioners. The tabulation has come to ministry for final vetting and its with Defence ministry finance accounts

Sr Adv Huzefa Ahmadi: 4 lakh pensioners have died waiting for pension and this is the same reason which was cited last time also. Now in Jan they say it will be disbursed in 4 monthly installments.

Ahmadi: now this will be used to even deny the equalisation. at least this has to be paid in one installment CJI: Please see it is done by March 15, 2023

CJI: AG says tabulation for nearly 25 lakh defence pensioners has been completed by controller of defence accounts Allahabad. Now it is pending with defence ministry and the time now stands extended till March 15, 2023

 Ahmadi: now they may disburse in 4 installments..

 CJI: There is an issue with outflow. something is needed for modernisation etc. let them complete the exercise by March 15, 2023 and if any issue then come back to us. we are here

CJI: Please see there is no delay in payment and installments since payment was due in 2019
