Dear Sir,
I am a defence (Air Force) pension beneficiary vide PPO-08/14/B/14315/2005 dt.01 Dec 05 {(Sr. No.696720-H, Ex-JWO but with a pension of Sgt ‘X’ Gp.)
& Pension account no.3709000 0100502160 of PNB, Sahibabad,
Ghaziabad-201005 (UP). I was released from Air HQ(VB) as JWO on 30 Nov
2005.
In
reference to several Armed Force Tribunal directives, the pensions have
been revised to JWO's rank pension to many a cases like me who held the
rank of JWO lesser than ten months also(some cases received an arrear
with 8% interest also). As mandated, the pension should have been
granted on the basis of last rank held for whatever period. However, I
have neither been paid the revised pension according to the above said
revision or received any intimation from PDAs till date.
A letter attached from AFRO would reveal that a clarification sought
afterwards also cleared SGT pension only with revision of weightage.
I have been debarred of this benefit for year. May
I know the reason for indifference? Do each individual need to approach
AFT pleading his case? I believe, if a directive is passed it should be
implemented for all affected cases. I hope, if not done timely the OROP
pension revision would also be affected and based on SGT pension only
in place of JWO, which would again require correction.
Therefore,
I request you to kindly look into the issue and instruct suitably to
revise the pension & make payment of the arrears at the earliest.

2. As per para 122 of Pension Regulations for the Air Force 1961 (Part -I). "Except as otherwise provided for, service pension is assessed on the lowest rank and lowest group held by an individual during the last ten months of his qualifying for pension". Further as per para 123, "A competent authority may condone a deficiency of service on a particular rank not exceeding three months, except on voluntary retirement". It is intimated that existing Govt. rules, condonation beyond three months in last rank service is not feasible. It is also intimated that the extent policy is not being amended or superseded till date in respect of Pre-06 pensioners."
3. It is intimated that all of you have not completed a minimum period of 10 months service as JWO and hence entitled for Sgt rank pension which is correct and in order as per policy in vogue.
4. It is also intimated that the various AFTs are passing orders on the basis of AFT(PB) New Delhi judgement dated 29 Jan 2010 passed in TA No. 339/2010 filed by Ex JWO Bharat Singh Khatana Vs UOI and others. It is pertinent to mention here that the AFT(PB) New Delhi Court order dated 29 Jan 2010 has been challenged before the Hon'ble Supreme Court of India and the case is pending for adjudication.

circumstances neccessited to seek clarification on the entitlement of pension to JCOs and OR and equavalent who were promoted to the next higher rank at the last spell of their service and unfortunately could not complete 10 months in the promoted tank OR even 9 months less 3 months permissible of condone of service with regards to the pensioner of pre-2006. A daught has raised now whether the rules position of such case pertaining to the pensioners of post 2006 have been changed or amended or not. Firstly whether is rules position is applicable to the JCOs and equavalent granted Hony Rank while in service ie on 26 Jan or 15 Aug and happened to retire on 31 Jan or 31 Aug of the same months. Secondly Hav granted Hony Nb/Sub on retirement after 1.1.2006 has been authorised to draw the Nb/Sub Pension through an amendment to the particular rule of DSR.Thirdly the pay scale of Hav of X Group is 4150 - 5650 of pre 2006 where as pay scale of Sergeant of pre 2006 is 5000 - 6500. While calculating the pension of Hav and Surgeant the highest pay of Rs 6500 was taken in to account and multiplied by 1.86 and arrived at12090 +Grade pay 2800 +MSP 2000 and X Group Pay of 1400 total works out to Rs 18290 - There by the pension of Hav increased abnormaly which clearly indicate the last pay drawn is not a critetion in the case.Fourthy pay scale of Sub Maj X Group of pre 2006 is 7250 - 10050 where as MWO Ist(x) is 7400 - 10200. Here also the pension calculation was based the maximum of 10200. The comment posted by the pensioner had served in the India Army for 28 years 9 Months and drawn pension for more than 20 years. He is ignorent about the present rules postion amendment to DSR,Pay and allowances Regulation, pension Regulation etc. Rrquest any one to clarify the correct position
ReplyDeleteThe case type of case is came up with Hon AFT Kochi and they have passed the orders to pay the arrears However the AFRO is not paying and it is understood from Adv Jagdeedsh who is also annAirforce veteran that Hon AFT Cochin has summoned the Dy AFRO to personal presence in May 2015 after the AFT reopens. ReplyDeleteEx-Jwo Arya Prem, my query remains unanswered ? also reply to, while in service the difference in X and Y group is Rs 1400 only,in OROP the difference should be 1400/2 = 700 only how come ? the difference of a 21 yrs Jwo is Rs 1750.
Deleteaccording to OROP Arrears Calculator, Y group 21 yrs Jwo as per pre-OROP basic 7903, the O R O P ARREARS from July 2014 to 29th Feb 2016 is as mentioned below.
July to Dec 2014 is 11802
Jan to June 2015 is 12144
Jul 15 to Feb 16 is 16648
Total Arrears is 40549. if divided into 4 installments
installment 1 10149
installment 2 10149
installment 3 10149
installment 4 10149 but i got my 1st installment RS 4722 only. please look into this issue.

DeleteWhy the reply is given as Delete, a Jwo who has put up 21 yrs of service, held the Jwo Rank for 3 yrs, why last Rank held pension is not valid, what does it means to say Reply delete. OROP Arrears of Y group Jwo: 885 - 7903 = 950, 950 x 107%, is 11802, 950 x 113% is 12144, 950 x 119% from July to Feb 2016 is 16648, total Arrears come to 40549, 40549/4 is 10149 x 4 installments where as it is calculated for 442 and paid only 4722. For this the reply

ReplyDeleteSir, I am also waiting for Suprem court should give their judgment in the favor of all Ex Air warrior who is suffering for re-fixation of pension on the basis of last rank held at the time of discharged lesser than 10 months . Sir , It is too late for giving the judgement by Hon'able Suprem Court in r/o TA 339/2010 filed by Ex JWO Bharat Singh Khatanavs UOI & others and which was chalanged by AFRO in Hon able Suprem Court. Govt should action for early judgement in r/o TAs filed by the all Ex Servicemen and there should be a time frame for giving judgment by the all fourt6s including AFts. Regards. ReplyDeleteMy father P.Neelakanda Pillai expired on 24/03/2016, and still my mother didn't receive the family
pension, when we went to DPDO for handover the pension book, that time they informed us she will get
the pension with in 2 month's, now ninth month is going on.
We wait for three months and again we visited DPDO, they are saying the PPO is lost from their hand.
For issuing the duplicate PPO, they send so many reminders to PCDA Allahabad, but from DPDO they are
saying still they didn't receive any response on this.
According to DPDO instruction I excalated this matter to Legal Adalat Mr.R.Naryana Prasad(Sr.Account
Officer), he took some steps on this, and on that basis PCDA Allahabad again asking us to send the PPO
no again, we send the PPNO from which my father drawn his pension. I got a surprising reply from them
the no which I given is wrong, and asking me again to provide the PPO no and Pension details.
I explain this matter to Mr. Narayana Prasad & Koshy Mathew DPDO Kottayam (Account officer), they told
me that Mr.Narayana Prasad already escalated this matter to your notice for getting the PPO no of my
father, they are saying still they didn't get any response.
Kindly help us to get the PPO details, for getting the Family pension further anymore delay.
I am forwarding the details of my father service which I known and collected from DPDO kottayam.
My father retired on 31/Aug/1985 and his Service no -610935 and he holding the designation of CPL and
his penson no TS-41598, and the PPO no AFSC78251985 from he drawn the pension.
we are trying to contact all the possibilities which we can achieve but that all is not sufficient. Due
to that reason.I am sending this email, Can you please help us to get the PPO details.

ReplyDeletei retired from Indian Navy as the rank of POME on 31-01-2001 after completion of 15 Year but my pension rank is LME due to lack of 10 month service in the last rank heald.
Am i eligible for the pension of POME please let me know.
