Armed Forces Tribunal cannot take sweeping decisions
Setting off widespread discontent among military personnel, the
Centre on Friday moved the Supreme Court against the judgment of the
Armed Forces Tribunal (AFT), which grants Non-Functional Upgrade (NFU)
to the armed forces.
The Special Leave Petition (SLP), filed by the Centre, came even as the military personnel are yet to receive their new salaries recommended by the Seventh Pay Commission.
According to a Ministry of Defence official, the decision to challenge the ruling of the AFT to grant NFU was prompted by its legal stand that the tribunal has no authority to take such a sweeping decision. The source, in fact, argued that the government was not against NFU for services.
The Sixth Pay Commission had granted NFU to most Group ‘A’ officers but not the military and paramilitary officers. Since then, the armed forces had been demanding a one-time notional NFU to ensure parity.

Core anomaly
NFU has been one of the core anomalies raised by the services in the Seventh Pay Commission recommendations, which are yet to be implemented for military personnel. There have been some reports, quoting Army chief General Bipin Rawat, saying that the issues would be sorted out by the end of April. The NFU entitles all officers of a batch, including those not promoted, to draw the salary and grade pay that the senior-most officer of their batch would get after a certain period. For instance, batch mates of a Secretary to the Government of India, who have not been promoted, will be entitled to the same pay after a certain period of time.The Sixth Pay Commission had granted NFU to most Group ‘A’ officers but not the military and paramilitary officers. Lot many cases are pending in AFT for a decade or more.How come the NFU litigation got priority among them for speedy finalisation?

Full of questions. Wish one could agree with the only answer-Since then the Armed Forces had/ have been demanding a one time notional NFU to ensure parity. Rubbish journalism. Dear Hindu, PL restraint from publishing such stories.
ReplyDeleteAs a member of Armed Forces community, my demand is OROP and not NFU. In principle I am against the concept. My orop is equivalence of work and status!

Deleteअसल बात येहै रक्षा मंत्रालय मे वकीलो की जरुरत से ज्यादा भीड हो गयी है इनका खर्च सरकार वहन करती है । अगर जेब से पैसा लगे तो कोई केस कोर्ट मे नही जाऐ । सब को आराम से अपना हक मिल जाऐ । पर वकील है मानते ही नही ।

If and NFU and MACP are the one and the same,then why two different names?.What do you talk about ? Then let us have the same heading as NFU for officers and other ranks.In that case I think your dignity OLQ will get infected,I think so

DeleteMACP is already there only for JCOs & ORs & there is nothing called MACP for Officers & JCOs & ORs are getting it with out going to court .I have also seen how seniors are cribbing that their juniors are getting same salary as their juniors due to MACP.Even people in Y gropu wnat the same pension as X group with out realizing that better qualification will result in better group & pay
NFU has not yet yet been granted & Officers have gone to court to get it.It is being called NFU since the government is calling it NFU.If they call it MACP then they will call it as MACP.The government has filed a SLP against it & even senior army officers are against it
Even army doctors have not been given higher grade pay where as all central govt doctors have already got it
Officers carryon to serve as long as 56 yeaespecially or more once they are commissioned. .however jaWans are restricted to ACRs promotions etcetc

MACP is just a peanuts benenefit granted to ors as compared to time scale promotions to offrs . why not NFU should be given to offrs and ors as well so that every sepoy should get jco, s payment
