    INDEFINITE STRIKE FROM 11TH JULY 2016

    33 LAKHS CENTRAL GOVERNMENT EMPLOYEES WILL PARTICIPATE

    A massive parliament march and rally of about 20000 Central Government Employees was held at Jantar Mantar, New Delhi on 24th June 2016. The rally was organized by National Joint Council of Action (NJCA) of Central Government Employees comprising Railways, Defence, Confederation and Postal organizations demanding modification in the recommendations of 7th Central Pay Commissions including minimum wage and fitment formula. Other demands are scrapping of New Contributory Pension Scheme, No FDI in Railways and Defence, Grant of Civil Servant status to Gramin Dak Sevaks, filling up of vacancies, enhancement of bonus ceiling, No outsourcing, downsizing, contractorisation and corporatisation etc.
    The NJCA had already given strike notice to Government on 9th June 2016. The Modi Government is not ready for a negotiated settlement with the staff side. The rally called upon the entirely of Central Government employees to intensify the campaign and preparations and make the strike a total success.
    The rally was presided by Shri. N. Raghavaiah (General Secretary, NFIR & Chairman NJCA), Coms. Shiv Gopal Mishra (General Secretary AIRF & Convenor NJCA), Sreekumar (Secretary General AIDEF) M. Krishnan (Secretary General, Confederation) R. N. Parashar (Secretary General, NFPE) Guman Singh (President, NFIR), Rakal Das Gupta (President, AIRF) K. K. N. Kutty (President, Confederation) B. C. Sharma (NFIR) S. K. Tyagi (AIRF), Mrs. Champa and Mrs. Gita Pandey addressed the rally
    About 33 lakhs Central Government Employees will participate in the strike. 40 lakhs Central Government Pensioners have declared their solidarity with the strike. Central Trade Unions had also extended their full support. State Government Employees Federations have cautioned the Central Government that they will also be compelled to join the strike if Government refuse to settle the demands relating to 7th CPC recommendations as majority of the state Governments are implementing the Central pay parity to their employees also.

    Ex-Servicemen move SC for 'fair' OROP working, annual revision

    The Indian Ex-Servicemen Movement (IESM) has moved the Supreme seeking implementation of one rank one pension scheme in a fair manner with an automatic revision on annual basis instead of the current policy of periodic review of once in five years.
    IESM along with other ex-service personnel has assailed the NDA government's policy of periodic review once in five years, saying that such an approach was dilution of the February 26, 2014, announcement by which the revision in the pension was to automatically pass on to the past pensioners on the annual basis.
    Confirming that they have moved the top court seeking fair and automatic revision in pension on annual basis, Maj. Gen. Satbir Singh (retired), spearheading the movement for OROP, told IANS, "As per the original definition given by government of India on February 26, 2014, the change in pensions would have been automatically passed on to past pensioners every year."
    "It (Feb. 26, 2014 announcement) had said that whenever there was a change in rate of pension, it would be automatically passed on to past pensioner. It should be done every year but government has now made provision for revision every five years. This kills the very soul of OROP," said Satbir Singh.
    The petition which is likely to be argued by the senior counsel Ram Jethamalani when the top court opens after the summer vacations has contended that five-yearly periodic review did not meet the demand of the ex-servicemen seeking one rank one pension for the service personnel who had retired with same length of service in the same rank.
    Seeking annual revision of the pension for the past pensioners, the IESM in its petition has referred to the December 19, 2011, report of the Rajya Sabha's Petition Committee then headed by Bhagat Singh Koshyari which rejected all reservation advanced by the government while "strongly recommending" OROP.
    In its 142nd report, the Koshyari Committee had said, "the Committee strongly recommends that Government should implement OROP in the defence forces across the board at the earliest".
    Having recommended the implementation of OROP, the Koshyari Committee said, "for future, the pay, allowances, pension, family pension, etc. in respect of the defence personnel should be determined by a separate commission so that their peculiar terms and conditions of service, the nature of duties they are required to perform, etc., which are quite different from the civilian work force, are duly taken into account while taking decision on the same."
    Koshyari, who was Rajya Sabha member belonging to the Bharatiya Janata Party, was Uttarakhand Chief Minister from October 30, 2001 to May 1, 2002.
    The petition by the IESM has referred to September 9, 2008, Supreme Court verdict by which it had directed that "the pay of all pensioners in the rank of Major General and its equivalent rank in the two other Wings of the Defence Services be notionally fixed at the rate given to similar officers of the same rank after the revision of pay scales with effect from 1.1.1996, and, thereafter, to compute their pensionary benefits on such basis with prospective effect from the date of filing of the writ petition."
    While directing the government to pay the difference in the revised pension and what Major Generals and their equivalent ranks in the Air Force and the Navy were getting earlier within three months with interest at 10 per cent per annum, the court had dismissed the plea by the Centre challenging the Punjab and Haryana High Court judgement.
    The high court by its May 26, 2005, judgement had directed the Centre to fix minimum pay scale of the Major General above that of the Brigadier and grant pay above that of a Brigadier as has been done in the case of post-January 1, 1996, retirees and consequently fix the pension and family pension accordingly.

    7th CPC: Secretaries group submits final report to Fin Min; Cabinet approval in 15 days

    New Delhi: It's good news for central government employees eagerly waiting for the implementation of 7th Pay Commission.
    The implementation of 7th Pay Commission appears to be a matter of a few days now. As per Dainik Jagran report, the Cabinet Secretary met the PMO officials on Wednesday and apprised them about the secretaries panel's recommendations on the salary and allowances hike recommended for central government employees.
    The secretaries panel reviewing the 7th pay commission's recommendations have submitted its report to the Finance Ministry. The Finance Ministry will prepare a note and present it before the Cabinet in the next 15 days.
    With the threat of strike by central government employees looming large, the Cabinet is expected to take a prompt decision on the recommendations resulting in notification.
    The salary hikes recommended are expected to apply from July.

    7th Pay Commission Latest News – Empowered Committee Meeting may be held Today

    New Delhi: The final meeting of the Empowered Committee of Secretaries, who is processing the recommendations of the 7th Pay Commission is set for today as the secretaries’ committee hopes to make its final recommendations before the Finance Minister Arun Jaitley within this month.

    Secretaries’ committee has been comparing notes, taking into account concerns from employees’ unions, Trade Unions and departments demands through Implementation Cell of Pay Commission recommendations in Finance Ministry which works as the Secretariat of the Empowered Committee of Secretaries.

    “This will be the final meeting of the Empowered Committee of Secretaries. After that, Pay Commission award will come out,” an official in Finance Ministry said adding “we have kept our fingers crossed on the Pay Commission award.”

    OROP JM AGITATION FIRST ANNIVERSARY--OPERATION DILLI CHALLO



    Today being the first anniversary of OROP agitation at Jantar Mantar, National federation of ESM felicitates all associations & its members who have participated in this historic Non-violent agitation. 
    This issue was outstanding for the last 40 years & many political parties and their successive Govts professed it but not implemented. Accidently the present political outfit which formed the Govt at centre also tried to take advantage the aspiration of ESM by including the OROP in their manifesto but soon after coming to power they were reluctant to grand OROP.
    It is under these circumstances we have united under the leadership pf Col.Inderjeet Singh & Gen Satbir Singh and formed united front of ESM which eventually became a mass all India movement.
    Realising the support it received from the various section of society, the reluctant Govt was forced to announce OROP though with some anomaly & efforts are still on to rectify the anomalies. The movement has shown an example to future generation of ESM to fight for their rightful dues in a non-violent manner.
    Let us congratulates all the veterans who have participated in the agitation at JM & different parts of the country. We also salutes those veterans who have spear headed this movement 1976-77

    OROP: Govt may extend tenure of judicial panel

    The Centre informed Delhi High Court Thursday that the tenure of the one-member judicial commission to look into the public hearing of One Rank One Pension scheme will be extended, as representations filed by ex-servicemen and others are yet to be submitted to the Commission.
    The central government’s standing counsel Anurag Ahluwalia, appearing on behalf of Defence Ministry, told the court that “over 2,500 representations” had been received by the ministry so far. “The representations are now being processed, and will then be submitted to the judicial commission,” said Ahluwalia, adding that the panel’s tenure “would have to be extended”.
    Former Chief Justice of Patna High Court L Narsimha Reddy was appointed the judicial commissioner to look into the implementation of the OROP scheme. The commission was expected to submit its recommendations within six months and its tenure is set to expire on June 14.
    Ex-serviceman S P Singh filed a PIL before the high court earlier this week, seeking orders to have an “effective public hearing” on the issue and claiming that the “people were not informed” how to submit their representations. The court, however, noted that a particular address had been allocated to the commission, and the representations could be sent via post.

    7th pay commission report before Cabinet in the last week of June; notification soon

    Zee News, 27 May, 2016 - New Delhi: Central government employees can expect to get some good news trickling in from government sources towards the end of June.
    As per reports, the Finance Ministry is likely to table the 7th Pay Commission report to the Cabinet for approval in the last week of June.
    The 7th pay panel headed by AK Mathur had recommended the minimum salary for central government employees at Rs 18,000 and maximum salary at Rs 2,50,000. As employees protested against the wage hike calling it the "lowest ever" raise, the government set up the Empowered Committee of Secretaries group to review the AK Mathur-panel's recommendations.
    The Empowered Committee of Secretaries on the Seventh Central Pay Commission is expected to soon wrap up its report on the remuneration of government employees.

    Sources added that even the Prime Minister's Office is keen on a favourable pay hike for the central government employees, so the panel is likely to recommend a minimum salary at Rs 24,000 and the highest salary at Rs 2,70,000.
    Sources added that the government is exploring options for meeting the additional payout over and above what was recommended by the 7th pay panel. The payout could be substantial with salary hike and arrears adding up to a Rs 1.02 lakh crore burden on government finances.
    Report add that once the report moves from the table of the empowered group of committee to the cabinet, there is no reason why the cabinet would inordinately delay it.
    The Finance Ministry is keen that higher salaries reach government employees just before the festive season starting mid-August, as spurt in consumption during the festive period will have a domino effect on the economy.

    LETTER SENT BY GEN SECRETARY AFVAI TO DESW REGARDING DELAY IN ISSUING CIRCULAR


    Ma'am,
    I am writing you this email in late night because I am not getting sleep due to people calling day and night about this circular. Are we near to issue this letter ?
    The environment is very curious about it as You might be knowing that defence people (especially JCO/ORs) were chiefly affected by this draconian rule. Why I called it "draconian" because we are made to retire and then this rule was applied because we did not serve 33 yrs. To tell you that When I was retired, I was merely 34 years old juggling the roads of Mumbai for a job.
    Anyway that is a matter of law and system is responsible for that, not any individual. But I sincerely request you to throw some light so people can be assured & made calm.

    CALCULATION ARREARS ON 50% PENSION FOR JCO/OR

    HOW TO GO ABOUT CALCULATION OF  ARREARS OF JCOs & Ors:- With coming of this rule the arrears will be due to those persons who have been receiving Pension lesser than the 50% of "Minimum of Pay in Pay Band" wef 01 Jan 2006 to 30 June 2014 ie upto the date of implementation of the OROP Scheme.
    2.  Hence the first and foremost item to know is the "Min of Pay in Pay Band"  pertaining to your Group and Rank. The above chart has been derived from various Circulars issued by PCDA(P). Do intimate in case there be some changes and modification is needed.

    3.   The amount by which you have been getting lesser than this amount is the Basic difference now payable per month.
     
    4.   In case of JCOs & ORs three Circulars ie 547, 430 and 501 are important. There will thus be three differences corresponding to periods as under :-


           (a)   Difference between MPinPB and figures in 547 from 01 Jan 2006 to 30 June 2009.
          (b)   Difference between MPinPB and figures of circulat 430 from 01 Jul 2009 to 23 Sep 2012.
    (c)   Difference between MPinPB and figures of Circular 501 from 24 Sep 2012 to 30 Jun 2014.



    5. Note down these figures where ever  they are less than the MPinPB. However in case they are higher than the MPinPB these are not to be taken into account and the difference be taken as Zero.
    6.   Multiply these three differences with Multiplication factors as under to add period and DA:-
      
           (a)  01 Jan 2006 to 30 Jun 2009   =   46.02.
           (b) 01 Jul  2009 to 23 Sep 2012.  =   
    57.62
           (c)  24 Sep 2012 to 30 Jun 2014.  =   
    39.76
    The sum of the resultant figure will the total arrears due to you

    Rs 3,186 Crore Given To Over 17 Lakh Veterans Under OROP: Manohar Parrikar
    New Delhi:  Over Rs. 3,186 crore has been paid to more than 17 lakh military veterans on account of One Rank One Pension (OROP) scheme and 100 per cent compliance is expected by the month-end, Defence Minister Manohar Parrikar today said.

    "17,29,358 pensioners have benefited from OROP to the tune of Rs. 3,186 crore. Expect to ensure cent per cent compliance by May end," Mr Parrikar tweeted.

    A section of veterans, who had been protesting for "complete" implementation of OROP, had recently called off their nearly a year-long protest at Jantar Mantar.

    They have now decided to take the legal route to press their demand.

    Mr Parrikar had in September last year announced implementation of the OROP for ex-servicemen but the veterans have been continuing with their protest demanding "complete" implementation of the scheme.

    Your CPPC is totally out of reach. They did not respond even when  a Senior IAS officer  from MoD (Joint Secretary ESW) wrote to them. I will forward you that mail also which Joint Secretary ESW from MoD sent to CPPC.
    If you can divert those mails to your CPPC, so with your influence of your office, lacks of ex servicemen and widows will be benefited

    Hope that with blessing of god, you would be doing good. We want to bring a very strange case, actually the side effect of PCDA circular 555, the orop circular which  re-introduced many obsoleted conditions for JCO/ORs and one them being pension for last rank held.
    This veteran was drawing pension of Warrant Officer and but due to circular 555, bank (SBI in this case) has issued the recovery notice (Copy enclosed) reason being that his last rank held is now not being considered as rank pensioned due to circular 555. Ma'am it is grave injustice under your umbrella and we impose our confidence in you that you will address this issue on priority.

    I have the honor to state the following for your kind and necessary action at your end -

    1. I am Veteran WO of Indian Air Force. Served in the Air Force for 30 years 161 days (Date of Joining 06.07.1963 to 13.12.1993) and held my last rank as WO till my discharge from Indian Air Force.

    2. On my discharge vide PPO No. 08/14/B/05728/1994 (copy attached). I was awarded JWO Pension at that time as per the rules.

    3. On the 6th CPC recommendations for Revision of Pension for PRE-2006 Retirees, as per change in rule for PRE-2006, I am suppose to have my WO (Group Y) pension as mentioned in MOD Letter No. 17(4) 2008(1) D(Pen/Pol) dated 11.11.2008, Foot Note Sr. No. 1 says RANK MEANS RANK LAST HELD NOT RANK FOR WHICH PENSIONED. I wrote to my PDA and finally I represented my case in the LokAdalat of PCDA(P) at Ludhiana on 25.06.2011 to Sh. M K Srivastva, Group Officer, O/o PCDA(Pensions), Allahabad and I was granted the pension for WO July' 2011 onwards.

    4. Now on the setting my pension as per OROP my PDA (SBI) CPPC, Panchkula, Haryana have given me pension for the rank of JWO as Rs. 10742.00 per month (basic pension) whereas my old pension was for WO Rs. 11970.00 per month (basic pension) as per 6th CPC. I approached Directorate of Air Veterans, they advised to PDA on email for doing the correction and award me the pension for the rank of WO. To my shock, my PDA (SBI) has sent me Notice for the recovery of Rs. 1,81,896.00. My PDA is demanding Corrigendum PPO where it should be clearly written as Pension to be given for the Last Rank Held, i.e. WO. My PDA has started giving me pension for JWO since March' 2016.

    It is requested in your honour to please help me in this case by issuing Corrigendum PPO for Pension of WO and necessary instructions to my PDA. My service and other records are as under:-

    AN APPEAL FROM COL ANIL KAUL Vrc

    Col Anil Kaul is in trouble today due to complicated medical problems.He has sacrificed his healt for OROP struggle at Jantar Mantar. He appeals as follows
    Ladies & gentlemen, friends and we’ll wishers ,
    In the past year or so while fully engrossed in the OROP struggle, I have had to cope with some personal medical issues. They have now reached a state where I am making this appeal. I have two issues to take care off. One is simple and is being addressed on 11/6 . A cataract operation being done at the Shroff Eye Centre in south Delhi. The other is a more serious and complex problem and that is to do with the failure of both my kidneys necessitating dialysis three times a week. I have been advised to undergo a transplant at the earliest. While all other parameters can be handled the availability of a donor is beyond my control. I have no blood relations to turn to as they have all moved on. I am 65 years, my blood group is A+. Should anyone be kind enough to help me please do contact me on my
