    7th pay commission report before Cabinet in the last week of June; notification soon

    Zee News, 27 May, 2016 - New Delhi: Central government employees can expect to get some good news trickling in from government sources towards the end of June.
    As per reports, the Finance Ministry is likely to table the 7th Pay Commission report to the Cabinet for approval in the last week of June.
    The 7th pay panel headed by AK Mathur had recommended the minimum salary for central government employees at Rs 18,000 and maximum salary at Rs 2,50,000. As employees protested against the wage hike calling it the "lowest ever" raise, the government set up the Empowered Committee of Secretaries group to review the AK Mathur-panel's recommendations.
    The Empowered Committee of Secretaries on the Seventh Central Pay Commission is expected to soon wrap up its report on the remuneration of government employees.

    Sources added that even the Prime Minister's Office is keen on a favourable pay hike for the central government employees, so the panel is likely to recommend a minimum salary at Rs 24,000 and the highest salary at Rs 2,70,000.
    Sources added that the government is exploring options for meeting the additional payout over and above what was recommended by the 7th pay panel. The payout could be substantial with salary hike and arrears adding up to a Rs 1.02 lakh crore burden on government finances.
    Report add that once the report moves from the table of the empowered group of committee to the cabinet, there is no reason why the cabinet would inordinately delay it.
    The Finance Ministry is keen that higher salaries reach government employees just before the festive season starting mid-August, as spurt in consumption during the festive period will have a domino effect on the economy.

    LETTER SENT BY GEN SECRETARY AFVAI TO DESW REGARDING DELAY IN ISSUING CIRCULAR


    Ma'am,
    I am writing you this email in late night because I am not getting sleep due to people calling day and night about this circular. Are we near to issue this letter ?
    The environment is very curious about it as You might be knowing that defence people (especially JCO/ORs) were chiefly affected by this draconian rule. Why I called it "draconian" because we are made to retire and then this rule was applied because we did not serve 33 yrs. To tell you that When I was retired, I was merely 34 years old juggling the roads of Mumbai for a job.
    Anyway that is a matter of law and system is responsible for that, not any individual. But I sincerely request you to throw some light so people can be assured & made calm.

    CALCULATION ARREARS ON 50% PENSION FOR JCO/OR

    HOW TO GO ABOUT CALCULATION OF  ARREARS OF JCOs & Ors:- With coming of this rule the arrears will be due to those persons who have been receiving Pension lesser than the 50% of "Minimum of Pay in Pay Band" wef 01 Jan 2006 to 30 June 2014 ie upto the date of implementation of the OROP Scheme.
    2.  Hence the first and foremost item to know is the "Min of Pay in Pay Band"  pertaining to your Group and Rank. The above chart has been derived from various Circulars issued by PCDA(P). Do intimate in case there be some changes and modification is needed.

    3.   The amount by which you have been getting lesser than this amount is the Basic difference now payable per month.
     
    4.   In case of JCOs & ORs three Circulars ie 547, 430 and 501 are important. There will thus be three differences corresponding to periods as under :-


           (a)   Difference between MPinPB and figures in 547 from 01 Jan 2006 to 30 June 2009.
          (b)   Difference between MPinPB and figures of circulat 430 from 01 Jul 2009 to 23 Sep 2012.
    (c)   Difference between MPinPB and figures of Circular 501 from 24 Sep 2012 to 30 Jun 2014.



    5. Note down these figures where ever  they are less than the MPinPB. However in case they are higher than the MPinPB these are not to be taken into account and the difference be taken as Zero.
    6.   Multiply these three differences with Multiplication factors as under to add period and DA:-
      
           (a)  01 Jan 2006 to 30 Jun 2009   =   46.02.
           (b) 01 Jul  2009 to 23 Sep 2012.  =   
    57.62
           (c)  24 Sep 2012 to 30 Jun 2014.  =   
    39.76
    The sum of the resultant figure will the total arrears due to you

    Rs 3,186 Crore Given To Over 17 Lakh Veterans Under OROP: Manohar Parrikar
    New Delhi:  Over Rs. 3,186 crore has been paid to more than 17 lakh military veterans on account of One Rank One Pension (OROP) scheme and 100 per cent compliance is expected by the month-end, Defence Minister Manohar Parrikar today said.

    "17,29,358 pensioners have benefited from OROP to the tune of Rs. 3,186 crore. Expect to ensure cent per cent compliance by May end," Mr Parrikar tweeted.

    A section of veterans, who had been protesting for "complete" implementation of OROP, had recently called off their nearly a year-long protest at Jantar Mantar.

    They have now decided to take the legal route to press their demand.

    Mr Parrikar had in September last year announced implementation of the OROP for ex-servicemen but the veterans have been continuing with their protest demanding "complete" implementation of the scheme.

    Your CPPC is totally out of reach. They did not respond even when  a Senior IAS officer  from MoD (Joint Secretary ESW) wrote to them. I will forward you that mail also which Joint Secretary ESW from MoD sent to CPPC.
    If you can divert those mails to your CPPC, so with your influence of your office, lacks of ex servicemen and widows will be benefited

    Hope that with blessing of god, you would be doing good. We want to bring a very strange case, actually the side effect of PCDA circular 555, the orop circular which  re-introduced many obsoleted conditions for JCO/ORs and one them being pension for last rank held.
    This veteran was drawing pension of Warrant Officer and but due to circular 555, bank (SBI in this case) has issued the recovery notice (Copy enclosed) reason being that his last rank held is now not being considered as rank pensioned due to circular 555. Ma'am it is grave injustice under your umbrella and we impose our confidence in you that you will address this issue on priority.

    I have the honor to state the following for your kind and necessary action at your end -

    1. I am Veteran WO of Indian Air Force. Served in the Air Force for 30 years 161 days (Date of Joining 06.07.1963 to 13.12.1993) and held my last rank as WO till my discharge from Indian Air Force.

    2. On my discharge vide PPO No. 08/14/B/05728/1994 (copy attached). I was awarded JWO Pension at that time as per the rules.

    3. On the 6th CPC recommendations for Revision of Pension for PRE-2006 Retirees, as per change in rule for PRE-2006, I am suppose to have my WO (Group Y) pension as mentioned in MOD Letter No. 17(4) 2008(1) D(Pen/Pol) dated 11.11.2008, Foot Note Sr. No. 1 says RANK MEANS RANK LAST HELD NOT RANK FOR WHICH PENSIONED. I wrote to my PDA and finally I represented my case in the LokAdalat of PCDA(P) at Ludhiana on 25.06.2011 to Sh. M K Srivastva, Group Officer, O/o PCDA(Pensions), Allahabad and I was granted the pension for WO July' 2011 onwards.

    4. Now on the setting my pension as per OROP my PDA (SBI) CPPC, Panchkula, Haryana have given me pension for the rank of JWO as Rs. 10742.00 per month (basic pension) whereas my old pension was for WO Rs. 11970.00 per month (basic pension) as per 6th CPC. I approached Directorate of Air Veterans, they advised to PDA on email for doing the correction and award me the pension for the rank of WO. To my shock, my PDA (SBI) has sent me Notice for the recovery of Rs. 1,81,896.00. My PDA is demanding Corrigendum PPO where it should be clearly written as Pension to be given for the Last Rank Held, i.e. WO. My PDA has started giving me pension for JWO since March' 2016.

    It is requested in your honour to please help me in this case by issuing Corrigendum PPO for Pension of WO and necessary instructions to my PDA. My service and other records are as under:-

    AN APPEAL FROM COL ANIL KAUL Vrc

    Col Anil Kaul is in trouble today due to complicated medical problems.He has sacrificed his healt for OROP struggle at Jantar Mantar. He appeals as follows
    Ladies & gentlemen, friends and we’ll wishers ,
    In the past year or so while fully engrossed in the OROP struggle, I have had to cope with some personal medical issues. They have now reached a state where I am making this appeal. I have two issues to take care off. One is simple and is being addressed on 11/6 . A cataract operation being done at the Shroff Eye Centre in south Delhi. The other is a more serious and complex problem and that is to do with the failure of both my kidneys necessitating dialysis three times a week. I have been advised to undergo a transplant at the earliest. While all other parameters can be handled the availability of a donor is beyond my control. I have no blood relations to turn to as they have all moved on. I am 65 years, my blood group is A+. Should anyone be kind enough to help me please do contact me on my

    Jethmalani to fight legal battle on OROP issue

    "I am 93-years-old and I can die any day but I assure you that it will not happen before I get you justice from Supreme Court," he said.

    Senior Supreme Court lawyer Ram Jethmalani today assured the ex-servicemen demanding “complete implementation” of ‘One Rank One Pension’ that he will lead their legal battle in the apex court.
    “I am 93-years-old and I can die any day but I assure you that it will not happen before I get you justice from Supreme Court,” Mr. Jethmalani said while addressing armed forces veterans staging protest at Jantar Mantar in the national capital.
    Major General (retd) Satbir Singh, leader of the protesting veterans, claimed that a case would be filed by Mr. Jethmalani on the OROP demand in the Supreme Court in the next 3-4 days and that Mr. Jethmalani would not charge any fee.
    Mr. Jethmalani, who has been fighting a legal case over the issue of black money in SC since 2009, also lashed out at the Narendra Modi government for “failing” to bring back black money stashed away abroad.
    “Modi promised to bring back black money from foreign countries and I believed him but he fooled me. But when German government offered to disclose the names of such bank account holders, no one from India approached it,” he claimed.

    Singh said four more cases have been filed in the armed forces tribunal.
    “These cases pertain to rulings for Jawans, war widows, arrears since 2006, payments for honourary ranks, rounding off of disability pension, and payments of reservists,” he said.
    The veterans’ protest at Jantar Mantar entered its 320th day on Friday.
    Defence Minister Manohar Parrikar had in September last year announced implementation of the long delayed OROP for ex-servicemen but the veterans have been continuing with their protest demanding “complete” implementation of the scheme.

    DENIAL OF OROP TO RESERVIST PENSIONERS-TRIBUNAL ISSUES NOTICE TO MOD

    The Armed Forces Tribunal, Chandigarh Bench, has issued notice to the Ministry of Defence on a petition challenging the notification issued by the Ministry regarding the one rank one pension (OROP) on February 3, 2016.
    The petitioners contend that para 4.1 of the notification deprives reservist pensioners /DSC Pensioners and those who are in receipt of two pension and many other categories from the benefits of one rank, one pension from July 1, 2014, which is illegal, discriminatory, arbitrary, resulting in violation of the Articles 14 and 16 of the Constitution and infringement to the Right to Property .
    The Bench of the AFT consisting of Justice Parkash Krishna and Lt Gen DS Sidhu ( Retd) issued notice for July 4, 2016, to the Ministry of Defence.
    The petitions were filed by the chairman of the All-India Ex-servicemen Welfare Association, Bhim Sen Sehgal, on behalf of the petitioners Baldev Singh, Raghuvir Singh, Bhuri Singh, Raj Mal, Chand Kishore Sharma and many others reservist pensioners, DSC pensioners, as well as those drawing two pensions but deprived of the one rank one pension from July7, 2014.
    The association has demanded setting aside of the portion of the notification and direction to the authorities for the grant of OROP to all categories of personnel, including the reservist pensioners, DSC pensioners and those drawing two pensions and the pensions of all these categories be revised from July 1, 2009, September 24, 2012 and then from July 1, 2014, onwards and all arrears be paid to them with interest and exemplary damages.
    Sehgal, who appeared for the (PBORs) submitted before the Bench that these reservist pensioners of the Indian Army had served during emergencies of the Indo-China Aggression of 1962, Indo-Pak War of 1965 and 1971 and on completion of their regular and reserve service of 15 years were granted the reservist pension of Rs 40 pm in 1972 which was revised to Rs. 375 pm from January 1,1986, then Rs1,275 pm from January 1,1996 and then Rs 3,500 pm w.e.f January 1, 2006, but thereafter there was no increase in their pension from July, 2009, September 24, 2012, and then from July 1, 2014 (on OROP). The association had already submitted representation to the authorities concerned but nothing has been done till date, hence the association moves the Armed Forces Tribunal for the relief to these unfortunate soldiers who are in advance stage of their life

At the same time you had informed us that as soon as Department of Pension of GOI issue any letter in this regard, you will immediately take the cognizance of report and issue the letter for defence personnel also.
    Now that department of Pension & Pensioner's welfare, Ministry of Personnel, PG & Pension  (GOI) have issued the letter no. 38/73/08-P & PW(A) dated 6-Apr-16 regarding delinking of 33 yrs condition, we are eagerly waiting letter from MoD (DESW) and we all request you to take all initiative in issuing the letter as early as and as previously informed to us.
